ORDINANCE NO. 041414
Rezoning
an area of approximately 1.5 acres generally located on
the north side of 47th Street between Madison Avenue and Summit Street
from District C-3a2 to District PD/C-3a2 and
approving a development plan for the same. (10111-PD-3).
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0608, rezoning an area of approximately 1.5 acres
generally located on the north side of 47th Street
between Madison Avenue and Summit Street from District
C-3a2 (Intermediate Business, High Buildings) to District PD/C-3a2 (Planned
District/Intermediate Business, High Buildings), said section to read as
follows:
Section 80-11A0608. That an area
legally described as:
All of Lots 18
through 36 inclusive, along with the vacated alley lying between the north line
of said Lots 18 and 31 and the North line of 47th Street, in Block
16, BUNKER HILL, a subdivision in Kansas City, Jackson County, Missouri.
is hereby rezoned from District C-3a2 (Intermediate Business, High Buildings) to
District PD/C-3a2 (Planned District/Intermediate Business, High Buildings),
all as shown outlined on a map marked Section 80-11A0608, which is attached
hereto and made a part hereof, and which is hereby adopted as a part of an
amendment to the zoning maps constituting a part of said chapter and as an
amendment to Section 80-11 thereof.
Section B. That a
development plan for the area legally described above is hereby approved,
subject to the following conditions:
1. That the developer secure permits to reconstruct and/or
repair existing sidewalks, curb and gutter, storm sewers and streetlights as
necessary along all development street frontages as required by the Department
of Public Works prior to the issuance of building permits.
2. That the developer submit a final plan to the City Plan
Commission for approval, including ATM/teller stations, the canopy design, new
lighting (with no direct illumination of any street right of way), new signage
and landscaping (including at least one canopy shade tree and groundcover).
3. That the
developer receive the approval of the Board of Zoning Adjustment for all
necessary variances.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices have been given and hearings have
been held as required by the Zoning Ordinance.
