ORDINANCE NO. 900685

 

Vacating the subdivision plats of "Indian Ridge", "Dehaemer's Subdivision" and that part of "Wilson Ritchey Addition" lying northerly of Missouri Route No. 9, including public roads and utility easements all in Kansas City, Clay County, Missouri.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City does hereby find and

declare that on the 31st day of January, 1990, a petition was filed with the City Clerk of Kansas City by Missouri Rental Machinery Company, d/b/a Briarcliff West Development Company for the vacation of "Indian Ridge", Lots 1 through 4, Block 1, Lots 1 through 19, Block 2, Lot 1, Block 6, N.W. 43rd Terrace from the west line of "Indian Ridge" to the east line of "Indian Ridge", and N.W. Wyoming Avenue from the north line of "Indian Ridge" south to the end of the cul-de-sac; "Dehaemer's Subdivision", Lots 1 through 3, and that part of Lot 4 lying westerly of U.S. Highway No. 169, and Troy Street (also known as Monet Road) from the westerly line of U.S. Highway No. 169 to the south line of the Southwest Fractional Quarter of Section 3, Township 50, Range 33; "Wilson Ritchey Addition", all that part of Lots 17 through 29 lying northeasterly of the northerly line of Missouri Route No. 9, including all public roads over, along and across the above-described lots lying outside the limits of the U.S. and State Highways, and including all public utility easements over, under, along and across the above-described streets and lots, giving the distinct description of the right-of-way to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given for twenty (20) days in the newspaper doing the city printing, and that the consent of the persons, and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said right-of-way has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council states that the City Plan

Commission has duly advised its approval of this Ordinance heron.

 

Section 3. That "Indian Ridge", Lots 1 through 4, Block 1,

Lots 1 through 19, Block 2, Lot 1, Block 6, N.W. 43rd Terrace from the west line of "Indian Ridge" to the east line of "Indian Ridge" and N.W. Wyoming Avenue from the north line of "Indian Ridge" south to the end of the cul-de-sac; "Dehaemer's Subdivision", Lots 1 through 3, and that part of Lot 4 lying westerly of U.S. Highway No. 169, and Troy Street (also known as Monet Road) from the westerly line of U.S. Highway No. 169 to the south line of the Southwest Fractional Quarter of Section 3, Township 50, Range 33; "Wilson Ritchey Addition", all that part of Lots 17 through 29 lying northeasterly of the northerly line of Missouri Route No. 9, including all public roads over, along and across the above-described lots lying outside the limits of the U.S. and State Highways, and including all public utility easements over, under, along and across the above-described streets and lots.

 

BE AND THE SAME IS HEREBY VACATED.

 

Section 4. That the City Clerk of Kansas City, Missouri, be

and is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri.

 

Section 5. All Ordinances or parts of Ordinances in

conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
