ORDINANCE NO080386

Accepting a warranty deed and partial release of deed conveying certain property in Clay County, Missouri, from Synergy Services, Inc. to the City of Kansas City, Missouri, for new public right-of-way use for the street now known as N.E. Parvin Road; and directing the City Clerk to record certain documents.

WHEREAS, said property shall be used for street purposes as a part of N.E. Parvin Road together with easements in remaining lands on the abutting property along and adjacent to said street, where required for the location, construction, and maintenance of an embankment or for sloping the sides of cut backs to construct and maintain said street at the established grade; also, said parties of the first part are hereby waiving damages, if any, by reason of the grading of said street; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the general warranty deed by and between Synergy Services, Inc. and the City of Kansas City, Missouri, conveying property to the City of Kansas City, Missouri, for street purposes, recorded at the following book and page numbers is hereby accepted.

Section 2. That the partial deed of release executed by Bank of America, N.A., dated April 30, 2007 and recorded on May 1, 2007 in the Office of the Recorder of Deeds for Clay County, Missouri as Document No. 2007017454, in consideration of partial payment of said debt does hereby release from the lien and effect of said deed of trust the following part of the property therein described, to-wit: New right-of-way for the street now known as N.E. Parvin Road over the following land. Beginning at the intersection of the south line of the north 10.00 feet of block 17, and the east line of said Block 17; thence South 00 degrees 13 Minutes 58 seconds West, along said east line, a distance of 6.27 feet; thence southeasterly 16.00 feet south of and parallel to the north line of said Block 17, along a curve to the left, having an initial tangent bearing of North 72 degrees 54 minutes 03 seconds west, having a radius of 486.96 feet, and an arc length of 472.02 feet; thence South 51degrees 33 minutes 42 seconds West, parallel to said north line, a distance of 273.94 feet; thence southwesterly along a curve to the right parallel to said north line, tangent to the last described course, having a radius of 722.20 feet, and an arc distance of 166.60 feet, to a point on the westerly line of said Block 17; thence North 11 degrees 23 minutes 23 seconds West, along said west line, a distance of 6.20 feet, to a point on a line lying south of and parallel to the north line of said Block 17; thence northeasterly parallel to said north line, along a curve to the left having an initial tangent bearing of North 63 degrees 48 minutes 20 seconds East, having an initial tangent bearing of North 63 degrees 48 minutes 20 seconds East, having a radius of 766.20 feet, and an arc length of 163,73 feet; thence North 51 degrees 33 minutes 42 seconds East parallel to said north line, a distance of 273.94 feet; thence northeasterly along a curve to the right, parallel to said north line, tangent to the last described course having a radius of 492.96 feet, and an acre distance of 476.02 feet, to the point of beginning. The above described tract contains 5,479 sq. ft. or 0.126 acres more or less.

The street is shown on the Synergy Services, Inc. preliminary plan amendment for Lot 17, Northgate, a subdivision of land in Kansas City, Clay County, Missouri. The owner hereby subordinates the lien and effect of said deed of trust to the easements and building lines as shown on said plan amendment. Provided, however, that this partial release shall not prejudice the lien of deed of trust on the remaining property therein described.
