ORDINANCE NO. 210235

 

Creating a new department to be known as the Housing Department by amending Chapter 2, Administration, Code of Ordinances, Division 9 by repealing Section 2-397; amending Chapter 2, Administration, Code of Ordinances, Division 13 by repealing Sections 2-521 and 2-525 and enacting a new Section 2-521; and amending Chapter 2, Administration, Code of Ordinances by enacting a new Division 15 entitled “Housing” to include new Sections 2-581 through 2-600.

 

WHEREAS, Section 401 of the Charter anticipates the occasional need for the City Council to reconsider the administration and delivery of City services by restructuring the departmental organization of City government by establishing additional departments under the administrative control of the City Manager; and

 

WHEREAS, on March 25, 2021, the City Council adopted the fiscal year 2021-2022 annual budget; and

 

WHEREAS, that annual budget provided for a change in the structure of the City government by appropriating funds for a new Housing Department; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 2, Administration, Code of Ordinances, Division 9 is hereby amended by repealing Section 2-397.

 

Section 2. That Chapter 2, Administration, Code of Ordinances, Division 13 is hereby amended by amending the title of the division, repealing Sections 2-521 and 2-525, and enacting a new Section 2-521 to read as follow:

 

DIVISION 13. - NEIGHBORHOODS

 

Sec. 2-521. Divisions; duties of director.

 

The neighborhoods department shall consist of the following divisions: administration; neighborhood services; neighborhood preservation; and any other divisions as may be established by ordinance. The work and responsibilities of the department shall be under the control and supervision of the director of neighborhoods who shall supervise the various divisions of the department in the performance of their functions and coordinate their activities and, when so instructed by the city manager, shall render such other related services as may from time to time be requested by the city manager or authorized by the city council. The director shall have all the powers as authorized by the Charter and ordinances including the power to prescribe and enforce rules and regulations, not inconsistent with the Charter, for the conduct of the employees of the department, and for the efficient management and operation of the department. The director shall have the authority to appoint such assistants and other employees as may be necessary to perform the functions of the department.

 

Section 3. That Chapter 2, Administration, Code of Ordinances, is amended by enacting a new Division 15 entitled “Housing” to include new Sections 2-581 through 2-600, to read as follows:

 

Sec. 2-581. Establishment.

 

Pursuant to the provisions of section 401 of the charter, there is hereby established a department to be known as the housing department. The officer in charge of such department shall be known as the director of the housing department, shall be appointed by the city manager, and shall have such duties, powers and authorities as are prescribed in this division, or as may hereafter be prescribed by the city manager in accordance with section 2-141, Code of Ordinances.

 

Sec. 2-582. Functions.

 

The department shall generally be responsible for housing rehabilitation and repair, rental housing assistance, project implementation, planning and special projects, fund management and compliance monitoring, and human services.

 

The department’s functions shall include overseeing and implementing the:

(1)               development and administration of programs to increase new housing construction and opportunities and an expansion and improvement of rehabilitation of existing housing within the city;

 

(2)               HOME investment partnership program;

 

(3)               planning and preparation of the grant application for the city's participation in the federal community development block grant (CDBG) program and the emergency solutions grant (ESG) program;

 

(4)               planning and preparation of the grant application for the city's participation in the federal and housing opportunities for persons with AIDS program (HOPWA), in cooperation with the health department;

 

(5)               planning and preparation of any grant applications for any state, federal, or other funding source relevant to supporting Housing, including but not limited to existing federal programs such as HOME and CDBG and future state and federal programs involving Housing;

 

(6)               management and monitoring of program operations conducted with funds received through various grant programs, with the department acting as principal contact with the federal government for all matters pertaining to planning and implementation of these grant programs;

 

(7)               education and resident assistance programs regarding the rules and processes related to healthy and safe living conditions for residential rental housing working with the Health Department, including an Office of Tenant Advocate;

 

(8)               coordination of city services to support the houseless;

 

(9)               regular updating of the City’s Housing Plan on at least a five (5) year basis;

 

(10)           identifying of strategies for funding and utilizing the Affordable Housing Trust Fund and providing an annual report to the City Council on these efforts;

 

(11)           conducting of a regular review of city incentive policies to determine their impact on housing preservation and construction; and

 

(12)           coordination with other relevant City Departments to identify opportunities to increase housing production and affordability.

 

Sec. 2-583. Personnel.

 

The director of the housing department shall appoint such subordinates and clerical employees as may be required to carry out the duties and functions of the department as established by ordinance, for whom appropriation of funds may be made by the city council from time to time.

Section 4. That the Director of Housing is designated as requisitioning authority for all the accounts in the Housing Department.
