COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 001466, AS AMENDED

 

Accepting the recommendations of the Tax Increment Financing Commission as to the Third Amendment to the Midtown Redevelopment Tax Increment Financing Plan, and approving the Third Amendment to the Midtown Redevelopment Tax Increment Financing Plan; stating the Councils intention with regard to funding for the Midtown Housing Project.

 

WHEREAS, pursuant to the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statutes of Missouri, 1986, as amended (the "Act"), the City Council of Kansas City, Missouri, by Ordinance No. 54556 passed on November 24, 1982, and thereafter repealed and amended in certain respects by Committee Substitute to Ordinance No. 911076, as amended, passed on August 29, 1991, created the Tax Increment Financing Commission of Kansas City, Missouri (the "Commission"); and

 

WHEREAS, the City adopted the Midtown Redevelopment Tax Increment Financing Plan (the "Plan") and designated the area therein (the Redevelopment Area) as a Redevelopment Area and found it to be blighted by committee substitute for Ordinance No. 930066, as further amended on April 1, 1993, and thereafter amended in certain respects by Ordinance No. 941127, passed on August 25, 1994 (the Ordinance); and

 

WHEREAS, on October 25, 1994, the Commission notified the City Clerk that it had reached the requisite agreement with the designated Redeveloper; and

 

WHEREAS, on June 8, 1995, the City Council passed Ordinance No. 950731, accepting the recommendations of the Commission as to the First Amendment to the Plan, approving the First Amendment to the Plan, and expanding the boundaries of both the 40th & Mill Project and the Linwood Corridor Project; and

 

WHEREAS, by Committee Substitute for Ordinance No. 991390, the City Council on November 23, 1999, approved the Second Amendment to the Plan, and therein directed the Commission to take the appropriate actions to recommend a complete housing program for consideration by the City Council no later than May 1, 2000, to make a progress report by March 30, 2000, and to commence this process no later than January 15, 2000, which shall allow for input and comment from a broad spectrum of neighborhood and other interested groups and individuals; and

 

WHEREAS, the Commission made its progress report to the City Council by March 30, 2000, in which it stated that a housing program could not be completed for consideration by the City Council by May 1, 2000, and that as soon as one was completed, it would be forwarded to the City Council for its action; and

 

WHEREAS, a complete housing program has now been prepared and was presented to the Commission for consideration (the Midtown TIF Housing Program) which, in accordance with the Plan, calls for the expenditure of revenues not required for completion of the 40th & Mill and Linwood Corridor Projects for rehabilitation of housing between 25th Street, 47th Street, The Paseo and State Line Road, and sets forth in detail the terms and conditions and other parameters governing the expenditure of such funds; and

 


WHEREAS, in order to authorize such expenditure of funds and incorporate the Midtown TIF Housing Program into the Plan, it was necessary to expand the boundaries of the Redevelopment Area so that it includes the area bounded by 25th Street, 47th Street, The Paseo and State Line Road, and to create a new redevelopment project (the Midtown Housing Program Project); and

 

WHEREAS, an amendment to the Plan (the Third Amendment) expanding the boundaries of the Redevelopment Area and creating the Midtown Housing Program Project was presented to the Commission for consideration; and on October 11, 2000, by Resolution No. 10-12-00, the Commission expressed its recommendation to the City Council that it approve the Third Amendment including the Midtown Housing Program Project; and

 

WHEREAS, none of the owners of the real property or businesses located within the expanded Redevelopment Area except those within the 40th & Mill and Linwood Corridor Redevelopment Project Areas shall be liable for the payments in lieu of taxes or economic activity taxes pursuant to the Plan; and

 

WHEREAS, the Third Amendment does not provide for the initial establishment or redevelopment of any gambling institution, alter any of the findings made by the City Council when approving the Plan nor does it alter or change in any way the effect on the taxing districts; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The recommendations of the Commission concerning the Third Amendment as set forth in the Resolution attached hereto as Exhibit "A" are hereby accepted and the Third Amendment, a copy of which is attached hereto as Exhibit "B," is hereby approved and adopted except that Exhibit 1 to the Third Amendment, Legal Description, is hereby deleted and a new Exhibit 1 attached hereto as Exhibit C is hereby inserted in its place; and Exhibit 14, Midtown Housing Program Project, is deleted and a new Exhibit 14, as attached to Exhibit C entitled Midtown Redevelopment Tax Increment Financing Plan Housing Program presented to the Tax Increment Financing Commission and as revised by the City Council April 12, 2001", is hereby inserted in its place.

 

Section 2. The following-described tract is hereby designated a Redevelopment Area:

 

THE MIDTOWN REDEVELOPMENT AREA

 

Beginning at a point at the intersection of the center line of State Line Road and the center line of 47th Street, thence bearing easterly along the meanderings of the center line of 47th Street to its point of intersection with the center line of The Paseo; thence northerly along the meanderings of the center line of The Paseo to its point of intersection with the center line of 25th Street; thence westerly along the meanderings of the center line of 25th Street to its point of intersection with the center line of Grand Avenue; thence westerly in a straight line along the prolongation of the center line of 25th Street (on the first westerly course that the center line takes after its intersection with the center line of Grand Avenue) to its point of intersection with the center line of State Line Road; thence southerly along the meanderings of the center line of State Line Road to the point of beginning, all in Kansas City, Jackson County, Missouri, but excluding the following tracts of land:

 

The 43rd & Main Tax Increment Financing Plan Redevelopment Area

Beginning at the intersection of 41st and Main Street; thence easterly along the center line of 41st Street to the northerly extension of the east lot line of Lot 64, GRAND AVENUE HIGHLANDS; thence southerly along the northerly extension of the east lot line of said Lot 64 and the east lot line of Lots 60 through 64, GRAND AVENUE HIGHLANDS, and CHECQUERS CONDO, and Lots 29 through 31, GRAND AVENUE HIGHLANDS, then crossing 43rd Street; thence continuing southerly along the center line of the north/south alley line between Warwick Boulevard and Walnut Street to the intersection with the easterly extension of the south lot line of Lot 45, WEST ESTATE; thence west 28 feet; thence south 40 feet, more or less, along the south lot line of said Lot 45; thence east 28 feet, more or less, to the center point of the north/south alley line between Warwick Avenue and Walnut Street; thence southerly along said center line to the center line of 44th Street; thence westerly along the center line of 44th Street to the center line of Main Street; thence southerly along the center line of Main Street to the easterly extension of the south lot line of Lot 14, WEST ESTATE; thence westerly along the south lot line of said Lot 14 and its easterly extension right-of-way of the Kansas City and Westport Belt Rail Road; thence proceeding northerly and westerly along said Kansas City and Westport Belt Railroad to the center line of 43rd Street; thence easterly along the center line of 43rd Street to the center line of Baltimore Avenue; thence northerly along the center line of Baltimore Avenue to the westerly extension of the north lot line of Lot 17, STEVE SMITHS SUBDIVISION; thence easterly along the north lot line of said Lot 17 to the east lot line of Lot 18, STEVE SMITHS SUBDIVISION; thence northerly along the east lot lines of Lots 18 through 22, STEVE SMITHS SUBDIVISION, to a point 40 feet north of the south lot line of said Lot 22; thence westerly along a line 40 feet north of and parallel to the south lot line of said Lot 22 to the center line of Baltimore Avenue; thence north along the center line of Baltimore Avenue to the center line of the Vietnam Veterans Memorial Drive; thence easterly along the center line of the Vietnam Veterans Memorial Drive to the center line of Main Street; thence north along the center line of Main Street to the Point Of Beginning, now all included in and a part of Kansas City, Jackson County, Missouri.

Commencing at the intersection of the center line of Main Street as it now exists and the center line of Warwick Trafficway as it now exists; thence South along the center line of Main Street to the center line of East 31st Street Terrace as it now exists; thence East along the center line of East 31st Street Terrace to the intersection with a north-south line 11.5 feet west of and parallel to the east lot line of Lot 26, LYNNS ADDITION; thence South along a line 11.5 west of and parallel to the east lot line of Lot 26, LYNNS ADDITION to the center line of the east-west alley lying between East 31st Street Terrace and East 32nd Street as it now exists; thence East along the center line of said east-west alley to the center line of McGee Street; thence north along the center line of McGee Street to intersection with an east-west line 22 feet south of and parallel to the north lot line of Lot 17, DEGROFF PLACE; thence east along the east-west line 22 feet south of and parallel to the north lot line of Lot 17, DEGROFF PLACE to the center line of the north-south alley lying between McGee Street and Oak Street; thence south along the center line of the north-south alley lying between McGee Street and Oak Street to the westerly prolongation of the south lot line of Lot 19, SPRINGFIELD PARK ADDITION; thence east along said westerly prolongation of and the south lot line of Lot 19, SPRINGFIELD PARK ADDITION to the center line of Oak Street as it now exists; thence South along the center line of Oak Street to the center line of Linwood Boulevard as it now exists; then east along the center line of Linwood Boulevard to the center line of Gillham Plaza as it now exists; thence north along the center line of Gillham Plaza to the center line of McGee Trafficway as it now exists; thence northwesterly along the center line of McGee Trafficway to the center line of Gillham Road as it now exists; thence north along the center line of Gillham Road to the center line of East 29th Street as it now exists; thence west along the center line of East 29th Street to the southern line of Union Cemetery as it now exists; thence west along the southern line of Union Cemetery to the west right-of-way line of Oak Street, said point being on the eastern line of Union Cemetery; thence north along the eastern line of Union Cemetery 25 feet to a point on the southern line of Union Cemetery; thence west along the southern line of Union Cemetery to the eastern line of Union Cemetery, said point being on a north-south line 12 feet west of and parallel to the western lot line of Lots 1 thru 19, COLEMAN PLACE; thence north along the eastern line of Union Cemetery, said line being 12 feet west of and parallel to the western lot line of Lots 1 thru 19, COLEMAN PLACE, to the southern line of Union Cemetery; thence west along the southern line of Union Cemetery to the western line of Union Cemetery, said point being on the east line of Tract D, UNION HILL 4th PLAT; thence north along the western line of Union Cemetery to the southern line of Union Cemetery, said point being on the north section line of the Southeast Quarter of the Northwest Quarter of Section 17, Township 49, Range 33; thence west along the southern line of Union Cemetery to the east right-of-way line of Grand Avenue as it now exists, said line being the western line of Union Cemetery; thence north along the east right-of-way line of Grand Avenue and the western line of Union Cemetery to the north line of Tract 2, LAFAYETTE SQUARE; thence west along the north line of Tract 2, LAFAYETTE SQUARE to the center line of Warwick Trafficway; thence southerly and westerly along the center line of Warwick Trafficway to the Point of Beginning, all included in and a part of the City of Kansas City, Jackson County, Missouri.

 

The Southtown Corridor 31st & Baltimore Area Tax Increment Financing Plan Redevelopment Area

All of Blocks 1. 2, 3, And 4, Mount Auburn; all of Lots 1 through 24, both inclusive, Broadway Park; Lots 4, 5 And 6, M. J. Paynes Subdivision; part of 29th Street, 30th Street and Baltimore Avenue, and the vacated street lying north of Lot 4, M. J. Paynes Subdivision, all in Kansas City, Jackson County, Missouri, described as follows: Beginning at the southeast corner of said Block 2, being the intersection of the north line of 31st Street and the west line of Main Street, as said streets are now established; thence northerly along the west line of Main Street, a distance of 776 feet, more or less, to the northeast corner of Lot 20, Block 1, Mount Auburn; thence northerly continuing along the west line of said Main Street, a distance of 1194 feet, more or less, to the southeast corner of Lot 3, M. J. Paynes Subdivision; thence west, a distance of 295 feet, more or less, to the southwest corner of the last said Lot 3; thence south, a distance of 60.00 feet to the northwest corner of said Lot 4, M. Section 3. No property within the Midtown Housing Program Project Area shall be required to pay Payments in Lieu of Taxes or Economic Activity Taxes without further notice and hearing in accordance with the statutory process to change the nature of the Project.

 

Section 4. The Council hereby states its intention that all funds eligible to be used for the Midtown Housing Project be made available for this program as soon as possible.
