SUBSTITUTE FOR RESOLUTION NO. 160951
Stating the Council’s intention
regarding the use of up to $800 million in general obligation bond proceeds in
the event that voters approve authorization of such bonds on April 4, 2017; and
directing the City Manager to annually include in the City’s five-year business
plan a recommendation on the amount of bonds to issue each year and specific
projects to be funded.
WHEREAS, the
Council has passed Committee Substitute for Ordinance No. 160877, which submits
proposals to voters for authorization of $800 million in new general obligation
bonds on April 4, 2017; and
WHEREAS, voter
approval of these proposals will provide a new source of funding for basic
capital infrastructure including but not limited to streets, bridges,
sidewalks, flood control, parks and public buildings; and
WHEREAS, this new
source of funding will not be used to cover Airport improvements or the
expansion of the Streetcar; and
WHEREAS, the City
Manager has recommended a 20-year, comprehensive capital improvements program
to the Council inclusive of the aforementioned $800 million in general
obligation bonds; and
WHEREAS, it is the
intent of the Council to approve the City Manager’s recommended capital
improvements plan, which focuses the use of the general obligation bonds’
portion of the plan on repairing, replacing, rebuilding, and expanding existing
infrastructure; and
WHEREAS, the City
charter requires the Council annually adopt a five-year financial plan, as part
of their annual business plan, by November 1st each year; and
WHEREAS, the
Council desires each year’s submitted five-year financial plan include a
recommendation from the City Manager regarding the amount of bonds to be issued
from the $800 million within the context of the City’s existing and projected
financial condition including full consideration of the City’s general
obligation credit rating and outlook and the effect of the proposed bond
issuance pattern on taxpayers, as the principal and interest payments for each
bond issue will be paid from property taxes generated from the City’s debt
levy; and
WHEREAS, the Mayor
and Council desire to state their intention concerning the allocation of the
bond proceeds, less costs of issuance, in the event that the proposals are
approved by the voters; NOW, THEREFORE,
BE IT RESOLVED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the Council hereby states that, in the event that the voters approve the
issuance of up to $600 million in general obligation bonds on April 4, 2017,
its goals for the allocation of such proceeds are as follows:
Street Construction and
Reconstruction projects shall focus on safety, capacity or reconstruction
of existing streets and include bike and pedestrian facilities where
appropriate, as referenced in Exhibit A. These projects include traffic
synchronization and other complete street concepts as appropriate, including
street trees.
Bridge Rehabilitation projects
shall focus on those projects which best improve the City’s bridge sufficiency
ratings so that 90% are rated in good or better condition. Examples of the
types of eligible projects in this category that may be funded in part or in
whole are:

Byram’s Ford bridge – Over Round Grove Creek
·
Gregory Boulevard bridge – Over the Big Blue River
·
Benton Boulevard bridge – Over Brush Creek
·
E. 12th Street bridge – Over the Big Blue River
Section 2. The
projects in the list attached as Exhibit A may change slightly over time as the
City implements an asset management system for its street network. Streets
needing significant repair may be identified to generate long-term financial
benefits to the City if addressed.
Sidewalk projects shall
focus on systematically repairing and replacing existing sidewalks without
assessment to adjoining property owners.

For all petitioned projects the City would provide a minimum 50%
match for petitioned neighborhood sidewalks where sidewalks do not currently
exist
o
Higher City contribution may be available in priority areas
(e.g., arterial streets, bus routes, and schools) and a further reduction for
benefitting property owners may be made available through pay-as-you-go funding
through the capital improvements sales tax

Funding will also address an estimated 450 intersections that
need ADA-compliant curb ramps
·
The City Manager will utilize the Full Employment Council job
training programs where possible to provide construction training opportunities
to individuals seeking job assistance
·
Furthermore, the City Manager is directed to stop the collection
of outstanding sidewalk special assessment balances if the bonds are authorized
by voters
Section 3. A
maximum amount of $150 million of the $600 million will be allocated to
sidewalk projects. The
Council agrees to develop a comprehensive plan that includes an assessment of
needs throughout the different council districts in order to allocate the
available funds. The final distribution of funds will be subject to Council
adopting an ordinance that implements the comprehensive plan.
Section 4. That
the Council hereby states that, in the event that the voters approve the
issuance of up to $150 million in general obligation bonds on April 4, 2017,
its goals for the allocation of such proceeds are as follows:
Flood Control projects shall
focus on completing and expanding efforts to protect homes and businesses. Examples
of the types of eligible projects in this category that may be funded in part
or in whole are:
Projects that leverage federal
funds for construction:

Enshriner’s Lake/Brush Creek – Dredge, restore shoreline, raise
trail for east end of Brush Creek

Swope Park Industrial Area
·
Dodson Industrial Area
·
KC Levees
·
Turkey Creek – Hillside drainage
Other Important Flood Control
Projects:
·
Brookside storm drainage – Prevent frequent flooding
·
Westport/Mill Creek drainage – Prevent frequent flooding

Line Creek – Channel stabilization and modification along East
Fork of Line Creek
·
Indian Creek – State Line to Wornall Road

Town Fork Creek – Prevent frequent flooding
Section 5. That
the Council hereby states that, in the event that the voters approve the
issuance of up to $50 million in general obligation bonds on April 4, 2017, its
goals for the allocation of such proceeds are as follows:
Public Buildings projects
shall focus on improving access, extending useful life and in some cases
building new facilities and repair of fountains and monuments. Examples
of the types of eligible projects in this category that may be funded in part
or in whole are:

KC Animal Shelter – Replace, enlarge, provide serviceable space
·
4900 Swope Parkway Office Building renovation
·
KC Museum – Restoration of Corinthian Hall
·
ADA upgrades and improvements at City Hall and various park
locations including Swope Park and Swope Park Pool
Section 6. That
the Council directs the City Manager to include in each year’s submitted
five-year financial plan and Capital Improvements Plan, a recommendation
regarding the amount of bonds to be issued from the $800 million in general
obligation bond authorization. Such plan will also detail the proposed
issuance pattern’s effect on the City’s financial condition, general obligation
credit rating and the impact on property tax rates and taxpayers.
Section 7. The
Public Improvements Advisory Committee (PIAC) shall review and comment on the
City Manager’s recommendations to the Council on the projects to be funded in
each bond issue. Recognizing that there are needs throughout Kansas City, use
of bond proceeds should be fairly distributed city-wide.
Section 8.
Directing the City Manager to implement a Community Benefit Agreement Plan in
conjunction with construction and reconstruction of each project exceeding
$300,000.00, which will support local workforce development and employment
opportunities, particularly among historically underrepresented groups, and
continuing to increase the number of local, women-owned, and minority-owned
business firm contracts with the City relating to infrastructure projects.
Section 9. That
the City Manager is directed to provide to the Council an annual report,
summarizing the use of the bond proceeds for the previous 12 months as well as
a report with a list of projects anticipated to be completed each year.
