ORDINANCE NO. 900794

 

Accepting various easements and deeds in Jackson, Clay and Platte Counties and releasing various easements in Jackson County.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements in Kansas City, Jackson County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

Section 4. That the legal descriptions for such properties listed in Sections 1 through 3 are set forth in Exhibit "A", which is attached hereto and incorporated herein by reference.

 

Section 5. That the utility easement previously retained by Kansas City Vacation Ordinance No. 26087, passed April 20, 1961, which lies in Lot 3, Plaza Steppes, Second Plat, a subdivision of land in Kansas City, Jackson County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 6. All that part of the Sewer Easement recorded in the office of the Recorder of Deeds for Jackson County, Missouri, at Kansas City, as Document No. R-479724, in Book B-5691, at page 677, a strip of land 10 feet wide lying 5 feet on each side of a line described as follows: beginning at a point on the north line of 103rd Street, said point being 185.00 feet west of the east line of the southwest quarter of the northeast quarter of Section 35, Township 48 North, Range 33 west, in Kansas City, Jackson County, Missouri, thence north along a line which is parallel to the east line of said quarter quarter section a distance of 230.0 feet, thence east along a line which is parallel to the north line of 103rd Street, a distance of 180.0 feet, thence north along a line which is parallel to and 5 feet west of the east line of said quarter quarter section a distance of 25 feet to the point of termination, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 7. That part of the platted utility easement located in Lot 11 and 12 of Judith Lants Subdivision, a subdivision in Kansas City, Jackson County, Missouri, described as follows: the north 5 feet of Lot 12, the east 5 feet of Lot 12, and the north 89 feet of the east 5 feet of Lot 11, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 8. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the offices of the Recorder of Deeds for Jackson County, Missouri, at Kansas City, for Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City, respectively.
