RESOLUTION NO. 190230

 

Directing the City Manager to take all necessary steps for the City to regulate medical marijuana facilities authorized by Article XIV, Section 1 of the Missouri Constitution.

 

WHEREAS, an amendment to Missouri’s Constitution was approved by voters on November 6, 2018, allowing access to medical marijuana in Missouri; and

 

WHEREAS, Article XIV, Section 1 of the Missouri Constitution authorizes state-licensed physicians to recommend marijuana for medical purposes to patients with serious illnesses and medical conditions; and

 

WHEREAS, the Missouri Department of Health and Senior Services is responsible for regulating and licensing medical marijuana cultivation, dispensary, manufacturing and testing facilities, and will begin accepting applications for such facilities in August 2019; and

 

WHEREAS, amendments may be needed to the City’s Code of Ordinances in order to accommodate medical marijuana facilities in the City; and

 

WHEREAS, the City desires to seek input from interested stakeholders, including neighborhood and community groups, and experts such as industry actors, cannabis advocates, and representatives from the medical community, with the end goal of developing a regulatory structure to accommodate medical marijuana facilities in the City that is beneficial to the citizens and taxpayers of the City; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is directed to take all necessary steps for the City to accommodate medical marijuana facilities authorized by Article XIV, Section 1 of the Missouri Constitution, and to include interested stakeholders in the process.

 

Section 2. That the City Manager is to report back to the City Council within 30 days of passage of this resolution.
