ORDINANCE NO. 950728

 

Approving a Community Unit Project on a tract of land of approximately 9.35 acres generally located on the east side of Phelps Road, approximately 450 feet south of Highway 40. (11632-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on a tract of land of approximately 9.35 acres generally located on the east side of Phelps Road, approximately 450 feet south of Highway 40, and more specifically described as follows:

 

All that part of the Southwest Quarter of Section 25, Township 49, Range 32 in Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the northeast corner of said Quarter Section; thence South 02 04'40" West along the east line of said Quarter Section, a distance of 48.97 feet to the south right of way line of U.S. Highway 40, said point also being the point of beginning of the tract of land herein to be described; thence South 02 04'40" West a distance of 849.49 feet; thence North 87 09'40" West a distance of 599.12 feet; thence North 08 56'30" West along the east right of way line of Phelps Road, a distance of 414.93 feet; thence North 09 41'10" West along said right of way line a distance of 94.11 feet; thence South 87 55'20" East a distance of 236.48 feet; thence North 02 04'40" East a distance of 129.43 feet; thence South 87 00'30" East a distance of 305.29 feet; thence North 22 48'32" East a distance of 233.85 feet; thence South 87 00'30" East a distance of 67.95 feet to the point of beginning. Containing 9.35 acres.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area and the proposed detention tract off-site to the north to be platted and processed in accordance with Chapter 66, Code of Ordinances

of the City of Kansas City, Missouri, as amended, commonly known as the

Subdivision Regulations.

 

2. That the developer dedicate additional right of way as required by the Department of Public Works for Phelps Road so as to provide 30 feet of right of way as measured

from the centerline of Phelps Road.

 

3. That the developer improve the east side of Phelps Road to collector street standards.

4. That the developer submit a storm drainage study for the entire development to the City Engineer's Office and make improvements as required by the City Engineer's

Office.

 

5. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

6. That the developer submit conditions, covenants and restrictions to the Law Department for approval.

 

7. That the developer secure the approval of the Street Naming Committee for all street names.

 

8. That the developer install hard surface roads and provide for fire protection prior to construction beyond foundations.

 

9. That the developer extend water mains as required by the Water Department.

 

10. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

11. That the developer contribute $9,068.22 in lieu of parkland dedication for 72 units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

12. That the developer submit a Certificate of Survey to the City for approval prior to the sale of the individual 4-plex units.

 

13. That the developer submit a street planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way.

 

14. That the developer submit a final plan to the City Plan Commission for approval, including provisions for landscaping.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 950728, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
