COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 900660

Authorizing execution of an agreement with the Missouri Highway and Transportation Commission authorizing use of air space over highway right of way under stated conditions for the Bartle Hall Expansion; and declaring an emergency.

WHEREAS, in order to maintain the schedule for construction of the expanded Bartle Hall in order to protect the City's investment to date and to assume the meeting of use commitments at the completion of construction, the airspace agreement to be approved by this ordinance must be approved and submitted to the Missouri State Highway and Transportation Commission at their meeting during the week of December 3, 1990; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Public Works is hereby authorized to enter into and execute an air space agreement with the Missouri Highway and Transportation Commission authorizing Kansas City to use air space over Highway Department right of way for the expansion of Bartle Hall under stated conditions. The said agreement shall be essentially in the form which is attached hereto and incorporated herein by reference.

Section 2. That this ordinance, being necessary for the immediate preservation of the public property, is declared to be an emergency measure and shall take effect immediately upon passage.
