Approving the preliminary plat
for The Manhattan on a 1.77 acre tract of land generally at the northwest
corner of 8th Street and Charlotte Street. (SD 1259)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat for The Manhattan on a 1.77 acre tract of land generally
at the northwest corner of 8th Street and Charlotte Street, and more
specifically described as follows:
All of Lots 5
through 9, Block 5, and the west 1/2 of the vacated alley lying east of and
adjacent to said lots, and the east 46 feet of vacated Holmes road lying west
of adjacent to said lots, all being in Rice's Addition, a subdivision in Kansas
City, Jackson County, Missouri; also, Lots 13 through 17, Block 5, and the
south 1/2 of the vacated alley lying north of and adjacent to said lots, all
being in Ranson & Hopkins Addition, a subdivision in Kansas City, Jackson
is hereby approved, subject to
the following conditions:
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
That the developer secure permits to repair sidewalks, curbs, and
gutters as necessary along all development street frontages or submit a letter
from a Missouri Licensed Civil Engineer stating that the sidewalks, curb and gutter
are in a good state of repair prior to recording of the plat.
That the developer submit covenants, conditions and restrictions to the
Law Department for approval for the maintenance of common elements and private
open space tracts.
That the developer submit an application to the Board of Zoning
Adjustment for any required variances.
That the developer install streetscape amenities as required by the City
Development Department and Parks and Recreation Department prior to recording
of the final plat.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
I hereby certify
that as required by Chapter 66, Code of Ordinances, the foregoing ordinance was
duly advertised and public hearings were held.
