ORDINANCE NO. 910342

 

Approving the preliminary plat of Park View Manor on a 50 acre tract of land located on the west side of N. Congress Avenue between N.W. 78th Street and N.W. 76th Place. (SD 0486)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Park View Manor on a 50 acre tract of land located on the west side of N. Congress Avenue, between N.W. 78th Street and N.W. 76th Place, and more specifically described as follows:

 

A tract of land in the Northwest Quarter of Section 13, Township 51 West, Range 34 North, Kansas City, Platte County, Missouri, more particularly described as follows: Commencing at the Northeast corner of said Quarter; thence South 0 degrees 18 minutes 39 seconds West along the East line of said Quarter, a distance of 2053.70 feet; thence North 89 degrees 43 minutes 50 seconds parallel with the North line of said Quarter, a distance of 30.00 feet to the point of beginning, said point being the Northeast corner of Lot 6, PARK FOREST 11th PLAT S-2, a subdivision of land in Kansas City, Platte County, Missouri, according to the recorded plat thereof; thence continuing North 89 degrees 43 minutes 50 seconds West parallel with the North line of said Quarter and on the North line extended of said PARK FOREST 11th PLAT S-2, a distance of 1722.91 feet to a point on the centerline of a 100 foot K.C.P.&L. easement, as recorded in Book 305 at Page 609 in the Platte County Recorder's Office; thence North 01 degree 02 minutes 03 seconds East along said easement centerline and along the centerline of an additional 100 foot K.C.P.&L. easement, as recorded in Book 301 at Page 103 in the Platte County Recorder's Office, a distance of 823.39 feet to a point on the centerline of a 10 foot sewer easement as recorded in Book 543 at Page 411 in the Platte County Recorder's Office; thence North 40 degrees 55 minutes 38 seconds East along said sewer easement centerline, a distance of 151.97 feet; thence North 44 degrees 15 minutes 02 seconds East along said sewer easement centerline, a distance of 226.65 feet to the southern most corner of Lot 80, SQUIRE'S HILL SECOND PLAT, a subdivision in Kansas City, Platte County, Missouri, according to the recorded plat thereof; thence continuing North 44 degrees 15 minutes 02 seconds East on the Southeasterly line of said SQUIRE'S HILL SECOND PLAT and the Southerly line of SQUIRE'S HILL, a subdivision in Kansas City, Platte County, Missouri, according to the recorded plat thereof,
said line also being the centerline of a sewer easement as recorded in Book 543 at Page 407 in the Platte County Recorder's Office, a distance of 920.00 feet to a point on the Southeasterly line of said SQUIRE'S HILL; thence South 89 degrees 43 minutes 50 seconds East along the Southeasterly line of said SQUIRE'S HILL and the Southwesterly line of WITTLAND ESTATES, a subdivision in Kansas City, Platte County, Missouri, according to the recorded plat thereof, a distance of 280.00 feet; thence South 55 degrees 47 minutes 50 seconds East on the Southerly line of said WITTLAND ESTATES, a distance of 286.62 feet; thence South 89 degrees 43 minutes 50 seconds East on the Southeasterly line of said WITTLAND ESTATES, a distance of 300.00 feet to a point on the Westerly right of way line of N. Congress Avenue, as now established and recorded in Book 283 at Page 465 in the Platte County Recorder's Office; thence South 0 degrees 18 minutes 39 seconds West along said Westerly right of way line and parallel with the East line of said Northwest Quarter, a distance of 1603.70 feet to the point of beginning. The above described tract of land contains 58.36 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in phases and in accordance with Chapter 31,

Code of General Ordinances of Kansas City, Missouri, as

amended, commonly known as the Subdivision Regulations.

 

2. That the developer improve the west half of N. Congress Avenue to collector street standards including sidewalks

and streetlights if required to be relocated.

 

3. That the developer provide adequate site distance at street intersections onto N. Congress Avenue.

 

4. That the developer construct temporary cul-de-sacs as required.

 

5. That the developer submit a storm drainage study as required.

 

6. That the developer submit private restrictions with the final plat.

 

7. That the developer install all-weather roads and provide fire protection prior to construction beyond foundations.

 


8. That the developer limit direct vehicular access to Lots 5, 15, 16, 104 to 107, 109, 110, 112 to 114 from N.

Congress Avenue.

 

9. That the developer extend water mains as required.

 

10. That a variance to the Subdivision Regulations required a maximum of lot depth to lot width ratio not to exceed

3 to 1 is hereby approved.

 

A copy of said plat is on file in the Office of the City Clerk under Document No. 910342 which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
