Approving a Community Unit Project on a 110 acre tract of land located at N.W. Belvidere and N. Congress. (4994-CUP-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on a 110 acre tract of land located at N.W. Belvidere and N. Congress, and more specifically described as follows:

 

A tract of land in the Northwest Quarter, the Southwest Quarter and the Southeast Quarter of Section 13, Township 51, Range 34, Kansas City, Platte County, Missouri, more particularly described as follows: Beginning at a point on the north-south centerline of said Section 13, 40 feet north of the center of said Section 13; thence North 022'31" East, along said north-south line, 542.74 feet; thence North 8942'02" West and parallel to the north line of the Northwest Quarter of said Section 13, 2210.5 feet to the centerline of N.W. Mace Road; thence South 230'00" West along said centerline, 586.9 feet to a point of intersection with the south line of said Northwest Quarter; thence South 2230'00" East, along said centerline, 712.2 feet to a point on the south line of the north half of the north half of the Southwest Quarter of said Section 13; thence east, along said south line, 1035.47 feet, more or less, to a point 928.13 feet west of the east line of said Southwest Quarter; thence South 018'14" West, parallel to said east line, 891.0 feet; thence east parallel to the south line of said Quarter Section, 399.08 feet; thence South 014'48" west, 350 feet; thence east, parallel to the south line of said Southwest Quarter, 115 feet; thence South 014'48" West, 250 feet; thence east, parallel to said south line, 413.45 feet to a point on the east line of said Quarter Section; thence south, along said east line, 478.5 feet to the southeast corner of said Southwest Quarter; thence east along the south line of the Southeast Quarter of said Section 13, 660.00 feet to the southwest corner of Lot 7, Block 15, PARK FOREST, a subdivision of record in Kansas City, Platte County, Missouri; thence north along the west line of Lots 7, 6, 5, 4, 3 and 1, and the northerly prolongation thereof, Block 15, said PARK FOREST, 644.79 feet to a point on the north right-of-way line of Northwest 73rd Street as now established; thence east along said north right-of-way line, 25.80 feet to the southwest corner of Lot 26, Block 17, said PARK FOREST, thence north along the west line of said Lot 26, 145 feet; thence east along the north lines of Lots 26, 25 and 24, said Block 17, 158.80 feet to the southwest corner of Lot 17, said Block 17; thence north along the west line of said Lot 17 and the northerly prolongation thereof, 189.19 feet to a point on the north right-of-way line of Northwest 73rd Street Terrace as now established; thence east along said north right-of-way line, 15.81 feet to the southwest corner of Lot 21, Block 8, said PARK FOREST; thence north along the west line of said Lot 21, 120.00 feet to the northwest corner of said Lot 21; thence easterly along the northerly line of said Lot 21 and Lot 20, said Block 8, 108.42 feet to the southwest corner of Lot 27, said Block 8; thence northerly along the westerly line of said Lot 27, 142.85 feet to the northwest corner of said Lot 27; thence northwesterly, 50.47 feet to a point on the north line of Northwest Autumn as now established, said point being also the southwest corner of Lot 18, Block 18, said PARK FOREST; thence northwesterly along the westerly line of said Lot 18, 120.71 feet to the northwesterly corner of said Lot 18, thence northeasterly along the northerly line of Lots 14 through 18, said Block 18, 295.00 feet to the southwest corner of Lot 13, said Block 18; thence north along the west line of said Lot 13 and Lot 12, said Block 18, 180.00 feet to a point on the south right-of-way line of Northwest 75th Street as now established; thence west along the south right-of-way line of said Northwest 75th Street 266.06 feet; thence continuing west along said south right-of-way line, along a curve to the right, tangent to the last described course, having a radius of 338.37 feet, an arc distance of 15.00 feet, to the northeast corner of Lot 11, Block 18, said PARK FOREST; thence south along the east line of said Lot 11, 165.00 feet to the southeast corner of said Lot 11; thence west along the south line of said Lot 11, 80 feet; thence northwesterly, along the southerly line of Lots 5, 6, 7, 8, 9, 10 and 11, said Block 18 to the southeast corner of Lot 4, said Block 18; thence westerly along the southerly line of Lots 2, 3, and 4, said Block 18 to the most northeasterly corner of Lot 29, said Block 18; thence southerly, along the east line of said Lot 29, and a prolongation thereof to the southerly line of N. Congress Avenue; thence northwesterly along said southerly line, to the most easterly corner of Lot 14, Block 19, said PARK FOREST, thence southwesterly, along the southerly line of said Lot 14, to the most southerly corner of said Lot 14; thence west along the southerly line of Lots 28, 29 and 30, said Block 19, 369.69 feet; thence northwesterly along the southerly line of Lots 30, 31 and 32, said Block 19, 175.38 feet; thence westerly along the south line of Lots 32 and 33, said Block 19, 90.45 feet to a point on the east line of N. Rhodes Road; thence westerly and at right angles with the centerline of said N. Rhodes Road, 60 feet to a point on the west line of said N. Rhodes Road; thence northerly along said west line, 484.48 feet; thence easterly and at right angles to the centerline of said N. Rhodes Road, 60 feet to a point on the east line of N. Rhodes Road, said point also lying on the north line of Northwest 75th Street; thence easterly along said north line to the southwest corner of Lot 5, Block 20, said PARK FOREST; thence north along the west line of Lots 1, 2, 3, 4 and 5, said Block 20, and the northerly prolongation thereof to a point on the north line of Northwest Belvidere Parkway; thence east, along said north line and the easterly prolongation thereof to the point of beginning, except that part in N. Congress Avenue, N. Mace Road and N.W. 73rd Street, containing 110.7 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations and submit private

covenants with platting.

 

2. That the developer improve N.W. 73rd Street from N. Rhodes to the east property line to secondary arterial

street standards including sidewalks.

 

3. That the developer construct all-weather roads and install fire hydrants prior to construction

 

4. That the developer receive the approval of the Street Naming Committee for all street names.

 

5. That the developer extend water mains as required by the Water Department.

 

6. That the developer dedicate 40 feet of right of way from the centerline on the east side of Mace Road and improve

the east half of Mace Road to secondary arterial street

standards.

 

7. That the requirement of sidewalk construction along proposed Lot 18, Phase 3B, on 75th Street is hereby

waived.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 920273, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
