ORDINANCE NO. 180068

 

Authorizing the City Manager to enter into a Cost Sharing Agreement with the Missouri Highways and Transportation Commission for the U.S. 169 “Buck” O'Neil Bridge over the Missouri River Project; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, Resolution No. 170265 directed the City Manager to engage with regional partners to develop and recommend a regional funding strategy to build a new U.S. 169/Buck O’Neil Bridge ("Bridge"); and

 

WHEREAS, in November of 2017 the Mid-America Regional Council approved $40,000,000.00 from the region’s share of the Federal Highway Administration Surface Transportation Program funding towards construction of a replacement of the Bridge; and

 

WHEREAS, the Missouri Highways and Transportation Commission (“MHTC”) has agreed to provide up to $100,000,000.00 for the construction of a replacement Bridge; and

 

WHEREAS, Resolution No. 170807 expressed the City’s support for the City applying for a 2017 Transportation Investment Generating Economic Recovery (TIGER 2017) Grant and a 2017-2018 Infrastructure for Rebuilding America (INFRA 2017-2018) Grant for the replacement of the Bridge which, at this time, applications have not been reviewed by the United States Department of Transportation; and

 

WHEREAS, Committee Substitute for Ordinance No. 170919 approved submitting to the voters at the April 3, 2018 election a 20 year extension of the City’s current 1% sales tax used for capital improvements which included proposed funding for the City’s share of the costs for the replacement of the Bridge offset by any TIGER or INFRA grants the City receives; and

WHEREAS, during the discussions with regional partners, the City applied to the MHTC’s Cost Share Committee for participation in the MHTC's Cost Share Program; and

 

WHEREAS, on October 18, 2017, the Cost Share Committee approved the City’s application to the Cost Share Program which would allow for work to be completed that would allow the existing Bridge to remain in service and accelerate the environmental work necessary for construction of a replacement Bridge; and

 

WHEREAS, the MHTC has designated the following project numbers associated with work on the over the Missouri River--J4S3085 – National Environmental Policy Act (NEPA) work Environmental Assessment (EA) for the rehabilitation or replacement of the Bridge and the long term rehabilitation or replacement of the Bridge and J4S3085B – Short term rehabilitation of the Bridge; and

WHEREAS, the NEPA for the long term rehabilitation or replacement of the Bridge is expected to be categorized by the Federal Highway Administration (“FHWA”) as an Environmental Assessment; and

 

WHEREAS, the Environmental Assessment and short term rehabilitation of the Bridge needs to begin in early 2018 in order to begin construction of a new Bridge within five years; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute a Cost Share Agreement with the Missouri Highways and Transportation Commission for the U.S. 169 “Buck” O'Neil Bridge over the Missouri River project.

Section 2. That this ordinance relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with that section.
