ORDINANCE NO. 910669

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2386, rezoning an area at the southwest corner of Armour Boulevard and The Paseo from Districts C-1 (Neighborhood Retail Business) and R-4 (Low Apartment) to District R-4 (Low Apartment), and consenting to the termination of a certain Voluntary Restriction Agreement recorded as Document No. K12086, Book K27, page 1385. WHEREAS, on February 8, 1968, Sam Eddy and Louise Eddy entered into a Voluntary Restriction Agreement concerning certain property located generally at the southwest corner of Armour Boulevard and The Paseo; and

 

WHEREAS, the purpose of the agreement was to limit the use of the subject property to certain residential and commercial uses; and

 

WHEREAS, the agreement was considered to run with the land and enforceable by the owner or owners of any lot or tract adjacent to the property or by the City of Kansas City; and

 

WHEREAS, said agreement was to run for a period of twenty (20) years and thereafter for successive periods of twenty (20) years unless the restrictions were changed, modified, amended, or released by the consent of the City Council of the City of Kansas City, Missouri, by appropriate ordinance, in which event the agreement would cease and be of no further force and effect; and

 

WHEREAS, by virtue of the zoning proposed in Case No. 9079-P-1 which would restrict the property to residential low apartment usage, it is in the best interest of the City to consent to the termination of the Voluntary Restriction Agreement; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2386, rezoning an area at the southwest corner of Armour Boulevard and The Paseo from Districts C-1 (Neighborhood Retail Business) and R-4 (Low Apartment) to District R-4 (Low Apartment), said section to read as follows:

 

Section 65.010A2386. That an area legally described as:

 

TRACT 1: That part of Lot 1 lying west of the west line of the Paseo and all of Lots 2, 3 and 4, in Block 4, SEDGWICK PLACE, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT 2: That part of Lot 20 lying west of the west line of the Paseo in Block 4, SEDGWICK PLACE, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT 3: That part of Lot 19 lying west of the west line of the Paseo in Block 4, SEDGWICK PLACE, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby rezoned from Districts C-1 (Neighborhood Retail Business) and R-4 (Low Apartment) to District R-4 (Low Apartment), all as shown outlined on a map marked Section 65.010A2386, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That the City of Kansas City hereby specifically consents to the change, modification, amendment or release of the Voluntary Restriction Agreement recorded as Document No. K12086, Book K27, page 1385, and further authorizes the Director of City Development to take any action appropriate to accomplish and certify the consent of the Council.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
