COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970961

Reducing the appropriation by the sum of $26,000.00 in the Neighborhood Special Project-CD5 account of the Capital Improvements Fund; appropriating said sum to the Brush creek North Plan-CD5 account; authorizing execution of a Third Amended Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City, increasing the contract amount by $310,000.00 for a total contract amount of $510,000.00 and extending the time of performance, for acquisition, clearance and public improvements in the Brush Creek North Redevelopment Area Plan; and directing the City Clerk to file certain documents with the appropriate offices.

WHEREAS, the City Council, through the passage of Ordinance No. 950387, authorized a Cooperative Agreement between the City and LCRA for acquisition, clearance and public improvements in the Brush Creek North Redevelopment Area; and

WHEREAS, the Council approved subsequent amendments to said Cooperative Agreement through the passage of Ordinance Nos. 950761 and 961393; and

WHEREAS, the Council, through the passage of Ordinance No. 970795, appropriated an additional $284,000.00 to said project; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the appropriation in the following account of the Capital Improvements Fund is hereby reduced in the following amount:

98-309-089-6503-T Neighborhood Special Project-CD5 $ 26,000.00

Section 2. That the sum of $20,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following account in the Capital Improvements Fund:

98-309-064-6501-T Brush Creek North Plan-CD5 $ 26,000.00

Section 3. That the Director of the Department of City Development is hereby authorized to execute a Third Amended Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City, Missouri, increasing the contract amount by $310,000.00 for a total contract amount of $510,000.00 and extending the time of performance, to provide for acquisition, clearance and public improvements in the Brush Creek North Redevelopment Area from funds previously and herein appropriated to Account Nos. 98-309-064-6506-T, Boys and Girls Club Improvements ($284,000.00) and 98-309-064-6501-T, Brush Creek North Plan CD5 (226,000.00). A copy of said Third Amended Cooperative Agreement, in substantial form, is attached hereto and is hereby approved.

Section 4. That the City Clerk is hereby directed to file a copy of said Third Amended Cooperative Agreement, together with a copy of this ordinance, in the office of the Department of Records of Jackson County, Missouri, and to file a copy with the office of the Secretary of State of Missouri.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
