Amending a previously approved preliminary plan in District GP-1 on approximately a 10.3 acre tract of land generally located at the southwest corner of Donovan Drive and N.W. Prairie View Road (5935-GP-11)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District GP-1 (General Industry) on approximately a 10.3 acre tract of land generally located at the southwest corner of Donovan Drive and N.W. Prairie View Road, and more specifically described as follows:

 

LOT 1, PARKWAY SELF STORAGE REPLAT

All that part of the Southeast Quarter of Section 1, Township 51 North, Range 34 West of the 5th P.M., in the City of Kansas City, Platte County, Missouri, described as follows: Commencing at the Southeast corner of the Southeast Quarter of Section 1, Township 51 North, Range 34 West; thence North 00 degrees 21 minutes 13 seconds East along the East line of said Section 1, a distance of 894.02 feet to a point on the North right of way line of an unnamed platted street per Plat of Hillside Heights; thence South 89 degrees 58 minutes 46 seconds West along north line of said platted street right of way a distance of 834.52 feet to the Southeast corner of Lot 1, Parkway Self Storage Replat, and point of beginning; thence South 89 degrees 58 minutes 46 seconds West along the South line of said lot 1 and its extension a distance of 518.92 feet to a point on the East line of Lot 1, Vintage at Pheasant Run-First Plat, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence North 00 degrees 19 minutes 08 seconds East along said East line a distance of 292.36 feet to the Northeast corner of said Lot 1, Vintage at Pheasant Run-First Plat, said point also being on the South line of Lot 1, The Lakes, Executive North, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence South 89 degrees 57 minutes 34 seconds East along said South line and its extension a distance of 510.31 feet to an angle point on the West line of Lot 1, Parkway Self Storage Replat; thence North 00 degrees 16 minutes 03 seconds East along the West line of said Lot 1, Parkway Self Storage Replat, a distance of 335.66 feet; thence along the North line of said lot 1 on a non-tangent curve to the left having a radius of 449.47 feet, an initial tangent bearing of South 83 degrees 04 minutes 58 seconds East, an arc distance of 250.46 feet; thence continuing along said North line, North 64 degrees 59 minutes 25 seconds East a distance of 214.88 feet to the Northeast of corner of Lot 1, Parkway Self Storage Replat; thence along the East line of Lot 1, Parkway Self Storage Replat, South 14 degrees 12 minutes 35 seconds West a distance of 422.80 feet (measured), South 14 degrees 11 minutes 02 seconds West, a distance of 422.91 feet (described); thence continuing along said East line, South 43 degrees 30 minutes 30 seconds West a distance of 478.88 feet (measured), South 43 degrees 24 minutes 21 seconds West a distance of 477.85 feet (described) to the point of beginning. Containing 329,125 square feet, (7.56 acres) of land more or less.

 

LOT 2, PARKWAY SELF STORAGE

All that part of the Southeast Quarter of Section 1, Township 51 North, Range 34 West of the 5th P.M., in the City of Kansas City, Platte County, Missouri, described as follows: Commencing at the Southeast corner of the Southeast Quarter of Section 1, Township 51 North, Range 34 West; thence North 00 degrees 21 minutes 13 seconds East along the East line of said Section 1, a distance of 894.02 feet to a point on the North right of way line of an unnamed platted street per Plat of Hillside Heights, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence South 89 degrees 58 minutes 46 seconds West along north line of said platted street right of way a distance of 834.52 feet to a point on the west right of way line of Northwest Prairie View, said point also being the southeast corner of Lot 1, Parkway Self Storage Replat, a subdivision of land in the City of Kansas City, Platte County, Missouri, and the point of beginning; thence South 43 degrees 30 minutes 30 seconds West along the West line of said right of way and its extension a distance of 337.43 feet (measured); thence continuing along the west right of way line of Northwest Prairie View Road, South 42 degrees 30 minutes 36 seconds West a distance of 75.11 feet (measured) to the northeast corner of Tract A, Vintage at Pheasant Run-First Plat, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence South 89 degrees 58 minutes 46 seconds West along the North line of said Tract A and its extension a distance of 237.53 feet to a point on the East line of Lot 1, Vintage at Pheasant Run-First Plat; thence North 00 degrees 19 minutes 08 seconds East along said East line a distance of 300.00 feet to the Southwest corner of Lot 1, Parkway Self Storage Replat; thence North 89 degrees 58 minutes 46 seconds East along the south line of said Lot 1 and its extension a distance of 518.92 feet to the point of beginning. Containing 113,248 square feet, (2.60 acres) of land more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro/micro storm drainage study for the entire development to the City Engineers Office for approval prior to or at the time of submittal of the first plat, and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer obtain the grading consents and all grading, temporary construction and drainage easements from abutting property owners prior to submitting any public improvements.

 

5. That the developer obtain a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer extend sanitary sewers to insure individual service is provided all proposed lots within the development and determine adequacy as required by the Department of Public Works.

 

7. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by the Department of Public Works.

 

8. That the developer secure permits to construct or reconstruct existing sidewalks, curb and gutter, storm sewers and streetlights as necessary along all development street frontages as required by the Department of Public Works prior to recording any final plat.

 

9. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer submit covenants conditions and restrictions to the Law Department for approval and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

12. That the developer petition for the vacation of the unnamed street right of way as shown on the development plan.

 

13. That the developer secure the approval of the Missouri Highway and Transportation Department for any work within State right of way.

 

14. That the developer grant a Noise and Aviation Easement to the City.

 

15. That the developer comply with the KCI Airport Height zoning restrictions and that the developer include a fair disclosure statement with any real estate transaction.

 

16. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), lighting (including a photometric study showing zero footcandles at the property line and no direct illumination beyond the property line) and building elevations.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
