COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120067

 

Authorizing a contract with HDR Engineering, Inc., for the Downtown Street Car Transit System; authorizing the Director of Capital Projects to enter into a cooperative agreement with KCATA; estimating $500,000.00 in the Capital Improvements Sales Tax Fund; appropriating $1,500,000.00 from the Unappropriated Fund Balance of the Capital Improvements Sales Tax Fund; stating the Mayor and City Council’s intention regarding advance funding for certain capital projects; and recognizing an emergency.

 

WHEREAS, the City of Kansas City, Missouri has conducted an Alternative Analysis and prepared initial Conceptual Engineering Technical Documents in conjunction with the Mid-America Regional Council, the Kansas City Area Transportation Authority, and Jackson County, Missouri; and

 

WHEREAS, based on the Alternatives Analysis and initial Conceptual Engineering work, the City Council in Resolution No. 110764 adopted the modern streetcar on the Main Street alignment as the preferred alternative; and

 

WHEREAS, Committee Substitute for Resolution No. 090341 provides funding, up to the amount estimated for certain capital projects, including design work, in the Five-Year Capital Improvements Program, as soon as possible to allow the City to begin work on the projects which meet the following criteria; and

 

WHEREAS, each Council District has designated Neighborhood Conservation Funds in FY 2012-13 for the Downtown Street Car System totaling $1 million; and

 

WHEREAS, these funds are now needed to adhere to the project timeline; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of the Capital Projects Department is hereby authorized to execute, on behalf of the City, a contract with HDR Engineering, Inc., for Project No. 87022000 - Downtown Street Car Transit System (FTA-KCATA Grant). A copy of the contract is on file in the Capital Projects Department.

 

Section 2. That the Director of Capital Projects is authorized to enter into a cooperative agreement with the Kansas City Area Transportation Authority to provide an FTA Grant in the amount of $500,000.00 for Advanced Conceptual Engineering on streetcars.

 


Section 3. That revenue in the following amount is estimated in the following account:

 

12-3090-870000-485110 Contribution-KCATA $ 500,000.00

 

Section 4. That $1,500,000.00 is appropriated from the Unappropriated Fund Balance of the Capital Improvements Sales Tax Fund to the following account:

 

12-3090-878044-B-87022000 Downtown Street Car System $1,500,000.00

 

Section 5. That it is the intent of the Mayor and City Council to repay the Capital Improvements Sales Tax Fund from Neighborhood Conservation funds programmed in FY 2012-13 for the Downtown Street Car System project per Committee Substitute for Resolution No. 090341 as follows:

 

13-3090-878100 Council District One $ 100,000.00

13-3090-878200 Council District Two 100,000.00

13-3090-878300 Council District Three 100,000.00

13-3090-878400 Council District Four 500,000.00

13-3090-878500 Council District Five 100,000.00

13-3090-878600 Council District Six 100,000.00

TOTAL $1,000,000.00

 

Section 6. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an emergency measure within the provisions of Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
