COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 960084

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2632, rezoning an area of approximately 60 acres generally bounded by Benton Plaza on the north, I-70 on the east, 23rd Street on the south, and Benton Avenue on the west from Districts R-2b (Two-Family Dwellings), C-3a1 (Intermediate Business, Low Buildings), M-1 (Light Industry), M-1-p (Light Industry - Limited District) and M-2a (Heavy Industry) to District URD (Urban Redevelopment District), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2632, rezoning an area of approximately 60 acres generally bounded by Benton Plaza on the north, I-70 on the east, 23rd Street on the south, and Benton Avenue on the west from Districts R-2b (Two-Family Dwellings), C-3a1 (Intermediate Business, Low Buildings), M-1 (Light Industry), M-1-p (Light Industry - Limited District) and M-2a (Heavy Industry) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 65.010A2632. That an area legally described as:

 

A tract of land in the South Half of Section 3, and the North Half of Section 10, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the southeast corner of the Northwest Quarter of said Section 10, thence North 02 18'57" East along the east line of said Northwest Quarters a distance of 114.05 feet to the point of beginning of the tract of land to be described said point also being the north right of way line of 23rd Street, as it is now established; thence North 87 33'24" West along said north right of way line a distance of 29.78 feet to a point on the west right of way line of Indiana Avenue as it is now established; thence North 02 15'25" East along said west right of way line a distance of 188.42 feet; Except that part taken for road right of way, alleys, and railroad right of way. Also except Lots 9, 10, 11, 12, and 13, Calkins Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby rezoned from Districts R-2b (Two-Family Dwellings), C-3a1 (Intermediate Business, Low Buildings), M-1 (Light Industry), M-1-p (Light Industry - Limited District) and M-2a (Heavy Industry) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 65.010A2632, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for the entire development for approval and that the developer make any improvements

as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for 18th Street so as to provide a total of 80 feet of right of way for 18th Street as required by the Department of

Public Works.

 

6. That the developer improve 18th Street to three lanes in conformance with arterial street standards as required by the Department of Public Works.

 

7. That the developer dedicate additional right of way for Agnes Avenue so as to provide a total of 60 feet of right of way for Agnes Avenue as required by the

Department of Public Works.

 

8. That the developer improve Agnes Avenue to collector street standards as required by the Department of Public Works.

 

9. That the developer dedicate additional right of way for Bellefontaine Avenue so as to provide 60 feet of right of way for Bellefontaine Avenue as required by the

Department of Public Works.

 

10. That the developer improve Bellefontaine Avenue to collector street standards as required by the Department of Public Works..

 

11. That the developer petition the City for street vacations as required by the City Engineer's Office and construct all cul-de-sacs as required by the City Engineer's

Office.

 

12. That the developer enlarge the radius for the northbound right turning movements to the southbound I-70 on-ramp as required by the approved traffic impact study.

 

13. That the developer provide adequate turning radii to accommodate truck traffic within the development as required by the Department of Public Works.

 

14. That the developer improve the intersection of 23rd Street and Indiana Avenue in accordance with the approved traffic study.

 

15. That the developer modify the signal at 18th Street and Indiana Avenue to accommodate changes to the intersection as required by the Department of Public

Works.

 

16. That the developer improve Indiana Avenue to a minimum three lane cross section with a dedicated center left turn lane as required by the Department of Public Works.

 

17. That the developer enlarge the curb returns on the north side of the intersection of 23rd Street and Indiana Avenue and make any other necessary changes to facilitate

turning movements for truck traffic turning northbound onto Indiana Avenue from

and to 23rd Street as required by the Department of Public Works.

 

18. That the developer modify the existing signal system to accommodate the improved Indiana Avenue three lane cross section as required by the Department of Public

Works.

 

19. That the developer obtain a permit from the Missouri Highway and Transportation Department for any work done in State right of way.

 

20. That the developer provide fire protection as required by the Fire Department.

 

21. That the developer install, loop, remove and/or relocate water mains as required by the Water Services Department.

 

22. That the developer provide covenants and restrictions as required.

 

23. That the developer provide sanitary sewers as required by the Water Services Department.

 

24. That the developer submit a site plan for each phase to the Director of the Department of City Development for approval prior to the issuance of a building

permit. The site plans shall include: development plan information, property uses,

setback distances, lighting, landscaping, signage and architectural characteristics.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 960084, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
