RESOLUTION NO. 091008

 

Amending the Eastgate Land Use and Development Plan by amending the Proposed Land Use Plan and Map for an area of approximately 13 1/2 acres generally located on the west side of Bennington Avenue at E. 55th Street by changing the recommended land use designation from low density residential to agricultural. ( 568-S-1)

 

WHEREAS, on October 20, 2001, the City Council by Resolution No. 011676 adopted the Eastgate Land Use and Development Plan as a guide for the future development and redevelopment for the area generally bounded by the Missouri Pacific Railroad line on the west, Interstate 435 on the east, Coal Mine Road on the north and 63rd Street Trafficway on the south; and

 

WHEREAS, after further review, it has been deemed appropriate to amend the Eastgate Land Use and Development Plan as it affects that area of approximately 13 1/2 acres generally located on the west side of Bennington Avenue at E. 55th Street by changing the recommended land use designation from low density residential to agricultural; and

 

WHEREAS, the City Plan Commission will consider such amendment to the Proposed and Use Plan and Map on January 5, 2010; and

 

WHEREAS, after all interested persons will be given an opportunity to present testimony, the City Plan Commission on January 5, 2010, recommended ______ of the proposed amendment to the Eastgate Land Use and Development Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Eastgate Land Use and Development Plan is hereby amended as to the Proposed Land Use Plan and Map for that area of approximately 13 1/2 acres generally located on the west side of Bennington Avenue at E. 55th Street by changing the recommended land use designation from low density residential to agricultural. A copy of the amendment to the Eastgate Land Use and Development Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the amendment to the Eastgate Land Use and Development Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
