ORDINANCE NO. 120806

 

Approving the Sixth Amendment to the Development Plan submitted by the Eighteenth and Vine Redevelopment Corporation; and authorizing the Director of Finance to enter into a Sixth Supplemental Contract with the Eighteenth and Vine Redevelopment Corporation. . (251-S-14)

 

WHEREAS, the Eighteenth and Vine Redevelopment Corporation, an urban redevelopment corporation of Missouri, submitted a Development Plan, which was approved by the Council by Ordinance No. 50555; and

WHEREAS, the Development Plan has been amended five times since its approval; and

WHEREAS, the Eighteenth and Vine Redevelopment Corporation filed a Sixth Amendment to the Development Plan with the City Clerk on March 30, 2012, as revised on July 6, 2012; and

WHEREAS, the Sixth Amendment proposes to revise the dates of completion in the Development Plan and to make certain other changes; and

WHEREAS, the City Clerk referred the Sixth Amendment to the City Plan Commission; and

WHEREAS, the City Plan Commission caused notice to be published in the Daily Record, a newspaper doing the City's printing on April 30, 2012, such date being not less than ten (10) days prior to the date set for the hearing; and

WHEREAS, the City Plan Commission held a public hearing on the Sixth Amendment to the Development Plan on May 15, 2012, at which time all interested persons were given an opportunity to be heard; and

WHEREAS, the City Plan Commission has made an independent study and investigation of the Sixth Amendment and recommended approval of the Sixth Amendment and submitted a report on the same, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Sixth Amendment to the Development Plan, filed with the City Clerk, and amended in accordance with recommendations of the City Plan Commission, is hereby incorporated herein by reference and approved

Section 2. That the Council finds and declares that good cause has been shown for the approval of the Sixth Amendment to the Development Plan of the Eighteenth and Vine Redevelopment Corporation and that the findings and declarations made by the Council in Sections 2 and 4 of Ordinance No. 50555, with respect to the Development Plan of the Eighteenth and Vine Redevelopment Corporation, have not been affected by the amendments thereto and equally apply to said Development Plan, as amended.

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the Development Plan, as amended.

Section 4. That the Director of Finance be, and he is hereby, authorized and directed on behalf of the City to enter into a Sixth Supplemental Contract with the Eighteenth and Vine Redevelopment Corporation, a copy of which in substantial form is attached hereto as Exhibit "B" and which is hereby incorporated herein by reference.
