ORDINANCE NO. 081156
Repealing Ordinance No. 960349
pertaining to the establishment of a separate fund for gaming receipts;
authorizing the recording of gaming revenues in the General Fund beginning May
1, 2009; and restating the intent of the Council with regard to the future use
of gaming funds.
WHEREAS, the
City Council, by Resolution Nos. 950505 and 950905, stated its intent to
allocate gaming revenues for the purpose of capital improvements and deferred
maintenance; and
WHEREAS,
Ordinance No. 960349 as approved on April 18, 1996, established the
Infrastructure and Maintenance Fund (No. 2090) for the receipt of revenues from
gaming activities; and
WHEREAS, further
City Council resolutions and ordinances allocated gaming revenues for debt
service on the expanded streetlight system, and debt service for the new
Performing Arts Center; and
WHEREAS, the
City Council through adoption of all budgets since FY 1996-97 has honored the
intent of this commitment and will continue to do so in future budgets until
all commitments have been fully honored; and
WHEREAS, in
an effort to reduce the number of funds used by the City, the City desires to
record all gaming receipts and expenditures in the General Fund beginning May
1, 2009; NOW, THEREFORE,
BE IT
ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1.
That Ordinance No. 960349 is hereby repealed with an effective date of May 1,
2009.
Section 2.
That the Director of Finance is hereby directed to deposit all revenues from
gaming admissions charges and gaming gross receipts into the General Fund
beginning May 1, 2009.
Section 3.
That the City Council states its intent to continue to use available gaming
funds to support the following City initiatives:
1.
Debt service on the streetlight system expansion;
2.
Debt service on the Citys contribution to the Kauffman Performing Arts
Center;
3.
Capital maintenance funding of City infrastructure
4.
Equipment replacement funding for City departments
