COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 180701

 

Amending Committee Substitute for Ordinance No. 160683 for the purpose of adding provisions to be utilized with respect to the scoring of residential site-based projects.

 

WHEREAS, the City Council by Committee Substitute for Ordinance No. 140031, As Amended, adopted the City’s Economic Development and Incentives Policy and directed the City Manager to develop the scoring system set forth therein; and

 

WHEREAS, the City Council by Ordinance No. 140375, adopted a certain scoring system for purposes of implementing the City’s Economic Development and Incentives Policy; and

 

WHEREAS, the City Council by Ordinance No. 160683 adopted a revised AdvanceKC Scorecard which recognized the need to evaluate incentives for Jobs-Based and Site-Based projects individually, and which prioritized substantial investments in the City’s most economically distressed areas, that create net new employment in quality jobs, with emphasis on target sectors, and encouraged sustainable and socially responsible development practices including historic preservation, efficient use of natural resources, increased mobility, and expansion of housing choices for residents; and

 

WHEREAS, the City Council desires to further revise the AdvanceKC Scorecard to increase scoring for affordable residential development projects, clarify the definition of affordable housing for the purpose of scoring economic development projects, and make other necessary administrative updates to the scorecard; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Section A of Committee Substitute for Ordinance No. 160683 is hereby amended to read as follows:

 

Section A. That Ordinance No. 140375 is hereby amended by repealing Section 1 thereof and enacting the following provision in lieu thereof:

 

Section 1. That the scoring systems, which are attached hereto as Exhibits A and B, are hereby adopted for purposes of implementing the City’s Economic Development and Incentives Policy. The scoring set forth in Exhibit A shall be in effect until such time as Ordinance No. 160683 shall become effective, and the scoring system set forth in Exhibit B shall be in effect thereafter, as modified herein.

 

Notwithstanding the foregoing, Exhibit B shall be deemed modified, at such time as Committee Substitute for Ordinance No. 180701 shall become effective, to incorporate the following changes pertaining to the criteria used to evaluate Residential-Site Based Projects:

 

·         Affordable housing shall be defined as either that (i) which a household having income equal to the applicable percentage of AMI (with regard to the additional points to be allocated) would be able to afford if it were to expend not more than thirty percent (30%) of such income for the mortgage or rent, inclusive of property taxes and utilities, or (ii) which has been approved for an allocation of LIHTC or other HUD Block Grant support funding. No project shall receive an allocation of points for improving and/or increasing the supply of affordable housing pursuant to Part V(b) of the Site Based Project Evaluation scoring system unless at least 10% of each residential unit type being constructed are affordable housing as defined herein and are maintained at this defined level of affordability for the duration of any incentives received, subject to annual verification.

 

·         AMI shall be defined as the median household income for all households within the City of Kansas City, Missouri, as established and reported by the most recently released American Community Survey 5-Year Estimates

 

·         Part II of the Site-Based Scorecard shall allocate up to 20 additional points to residential projects that make certain real property investments as follows – 5 points for project up to $3m over 10 years; 10 points for projects between 3-$15M over 10 years; 15 points for projects between $15-40M over 10 years; and 20 points for projects exceeding $40M over 10 years.

 

·         The Site Based Scorecard shall allocate up to 25 additional points for Residential projects that meet certain affordability thresholds – 20 points for projects that include at least 10% of units affordable at or below 40% AMI; 15 points for projects that include at least 10% of units affordable at or below 60% of AMI; 10 points for projects affordable at or below 80% of AMI; 5 points for projects affordable at or below 100% of AMI; and an additional 5 points (or up to 25 points total) for any projects include 20% or more of units at or below 100% AMI. Projects receiving an allocation of LIHTC or HUD Block Grant Funds shall receive the maximum of 25 points.
