COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 190528

 

Authorizing a fourth amendment to the Cooperative Agreement for Design and Construction with the Performing Arts Community Improvement District and others; approving the removal of real property from the Performing Arts Community Improvement District generally bounded by 12th Street on the north, 17th Street on the south, Wyandotte Street/Baltimore Avenue on the east and Broadway on the west, in Kansas City, Jackson County, Missouri; and directing the City Clerk to report the CID property removal to the Missouri Department of Economic Development.

 

WHEREAS, the Performing Arts Community Improvement District (PACID) was approved and established by Ordinance No. 030504; and

 

WHEREAS, pursuant to Section 67.1441, RSMo, a request to remove real property from the District has been received and a public hearing has been held on the request; and

 

WHEREAS, Section 67.1441, RSMo, requires the consent of the PACID’s Board of Directors to remove real property from the PACID; and

 

WHEREAS, the PACID’s Board passed Resolution No. 2019-04 on March 25, 2019 in which it consented to the removal of the real property described on Exhibit A upon the execution of the Fourth Amendment to the Cooperative Agreement for Design and Construction concerning the Performing Arts Center public garage and related facilities (Cooperative Agreement); and

 

WHEREAS, on April 10, 2008, the City Council passed Second Committee Substitute for Ordinance No. 071045, as amended, authorizing the execution of the Cooperative Agreement; and

 

WHEREAS, the Cooperative Agreement authorized by 071045 has been amended three times previously; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute the Fourth Amendment to the Cooperative Agreement for Design and Construction of the Parking Garage adjacent to the Performing Arts Center on behalf of the City with the Performing Arts Community Improvement District, the Kauffman Center for the Performing Arts and PAC Holding, Inc. A copy of the amendment in substantial form is on file in the City Attorney’s Office.

 

Section 2. That the property described on Exhibit A attached to this ordinance is removed from the Performing Arts Community Improvement District (the “District”) in accordance with Section 67.1401 through Section 67.1571, RSMo, otherwise known as the Missouri Community Improvement District Act (the “Act”).

 

Section 3. That upon the effective date of this Ordinance, the City Clerk is hereby directed to report the removal of the real property from the District to the Missouri Department of Economic Development by sending copy of this ordinance to said agency.
