ORDINANCE NO. 140751

 

Granting a Certificate of Economic Hardship for the demolition of the building at 2125 Tracy Avenue.

 

WHEREAS, the Western Baptist Bible College applied for a Certificate of Economic Hardship from the Historic Preservation Commission for the demolition of the building located at 2125 Tracy Avenue; and

 

WHEREAS, the building is located on the following parcel more specifically described as follows: The south 120 feet of Block Q, Lockridge's Addition, a subdivision in Kansas City, Jackson County, Missouri; and

 

WHEREAS, there are two buildings on this parcel, 2119 Tracy and 2125 Tracy, and the Certificate of Economic Hardship applies only to the building at 2125 Tracy; and

 

WHEREAS, after hearing evidence, the Historic Preservation Commission denied the request for a Certificate of Economic Hardship for the demolition at 2125 Tracy Avenue on June 27, 2014; and

 

WHEREAS, Chapter 88-585-05-F-5 of the Kansas City Administrative Code allows the Council to grant a certificate of economic hardship denied by the Historic Preservation Commission through passage of an ordinance which includes a declaration that the proposed work is necessary for the public health, welfare or safety; and

 

WHEREAS, demolition of the building at 2125 Tracy Avenue is necessary for public welfare on the basis of its current deteriorated condition; and

 

WHEREAS, based on evidence of the pro forma and rehabilitation estimates, the Council has determined that it is not economically feasible to rehabilitate the building at 2125 Tracy Avenue, and that requiring a reuse of the building when it is not economically feasible to do so would pose an economic hardship on the property owner; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council hereby declares that the proposed work to demolish the building at 2125 Tracy Avenue is necessary for public welfare and determines that the building is not economically feasible to rehabilitate.

 


Section 2. That the Council grants a Certificate of Economic Hardship to the owner of the building at 2125 Tracy Avenue, legally described above, and permits may be issued for the demolition of the building.
