ORDINANCE NO. 180707

 

Authorizing Change Order No. 3 with J. M. Fahey Construction Company in the amount of $107,755.90 for the 135th Street Phase 3 from Wornall Road to M-150 Project; authorizing the Director of Public Works to enter contract changes up to and including twenty percent (20%) of the original contract price; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, on December 14, 2017, the Council approved Ordinance No. 170952, a construction contract with J.M. Fahey Construction Company in the amount of $2,449,963.36 for the Project; and

 

WHEREAS, the Director of Public Works authorized Change Orders No. 1 and No. 2 for an additional $186,076.43 to the Project; and

 

WHEREAS, Change Order No. 3 is needed to compensate the contractor for additional construction work; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Public Works is authorized to execute Change Order No. 3 in the amount of $107,755.90 from funds previously appropriated to Account No. AL-3518-898013-B-89008518 for Project No. 89008518 – 135th Street Phase 3 from Wornall Road to M-150 with J.M. Fahey Construction for additional construction work, bringing the total contract amount to $2,743,795.69. A copy of the change order is on file in the Public Works Department.

Section 2. That the Director of Public Works is authorized to enter into contract changes up to and including twenty percent (20%) of the original contract price for related work.

Section 3. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
