COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 911466

 

Directing the City Manager to prepare fiscal notes for certain legislation.

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is directed to prepare fiscal notes for every City ordinance or resolution that meets any of the following criteria:

 

(a) Directs an expansion of services which entails

additional costs beyond that approved in the current adopted city budget;

 

(b) Directs the undertaking of a new service for which

no funding is provided in the current adopted city budget;

 

(c) Approves a commitment of city funding in the future

under certain specified conditions;

 

(d) Authorizes issuance of bonds, notes and

lease-purchase agreements which may require additional funding beyond that approved in the current adopted city budget;

 

(e) Authorizes the execution or initiation of an

activity as a result of federal or state mandates or requirements;

 

(f) Authorizes or approves a capital improvement project

that increases operating costs over the current adopted city budget; or

 

(g) Authorizes or approves a capital improvement project

that requires funding not approved in the current adopted budget or that will require funding in future years.

 

Section 2. That the fiscal note shall state:

 

(a) The cost of the implementation of the proposed

ordinance or resolution to the City for the current and next two fiscal years;

 

(b) The cost of the implementation of the proposed

ordinance or resolution to the City in subsequent fiscal years under certain specified conditions;

 

(c) The amount of non-city funds that may be received in

the current and next two fiscal years;

 

(d) A description of the annual operating, equipment and

maintenance costs;

 

(e) Such additional information as may be deemed

necessary or desirable by the City Manager.

 

Section 3. That the City Manager is further authorized and directed to establish appropriate procedures and forms for the preparation of fiscal notes as herein required.

 

Section 4. That the City Manager is directed to attach a fiscal note to all ordinances and resolutions before docketing for first reading before the City Council. Ordinances and resolutions introduced for first reading from the floor of the City Council shall be held for three weeks on the committee docket for attachment of a fiscal note unless preparation of such fiscal note is specifically exempted by the City Council.
