ORDINANCE NO. 060756

 

Approving the preliminary plat of Holly Ridge 1st Plat on an approximately 18.43 acre tract of land located on both sides of N. Holly St. (extended at approximately NW. 78th Terrace) and NW. 77th St., west side of U.S. Highway 169. (SD 0796D)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Holly Ridge 1st Plat on an approximately 18.43 acre tract of land located on both sides of N. Holly St. (extended at approximately NW. 78th Terrace) and NW. 77th St., west side of U.S. Highway 169, and more specifically described as follows:

 

Part of the Northeast Quarter of Section 15, Township 51, Range 33, in Kansas City, Clay County, Missouri, described as follows: Commencing at the Southwest corner of said Northeast Quarter; thence North 003433 East, along the West line thereof, 426.62 feet (Plat-426.24) to the Point of Beginning; thence continuing North 003433 East, along said West line, 1163.49 feet; thence South 895556 East, 674.38 feet; thence South 022553 West, 44.47 feet; thence Southerly, along a curve to the left, having a radius of 800 feet for an arc distance of 76.31 feet; thence South 030202 East, 532.24 feet; thence Southerly, along a curve to the right, having a radius of 830 feet for an arc distance of 409.56 feet; thence North 644542 West, 60.00 feet; thence Southwesterly, along a curve to the right, having an initial tangent bearing of South 251418 West and a radius of 770 feet for an arc distance of 135.84 feet; thence Southerly, along a curve to the right, having a common tangent with the last described course and a radius of 470 feet for an arc distance of 176.79 feet; thence North 581357 West, 187.13 feet; thence North 892537 West, 226.21 feet to the Point of Beginning. Containing 18.279 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer pay money in lieu of parkland dedication in the amount of $17,213.66 in satisfaction of Section 66-128 of the Subdivision Regulations.

 

2. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri commonly known as the Subdivision Regulations.

 

3. That the developer cause the area to be platted as a condominium in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri.

 


4. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first final plat is submitted and that the developer construct any improvements as required and make requested contributions towards the design and construction of the regional storm water detention basin.

 

5. That the developer submit construction plans prior to starting any work.

 

6. That developer submit plans for silt and erosion control and grading prior to beginning any work.

 

7. That the developer submit declarations, covenants and restrictions to maintain the private open space tracts to the Law Department for approval.

 

8. That the developer construct hard surface temporary fire access roads as required by the Fire Department and fire protection be in place prior to construction beyond foundations.

 

9. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in front of residential lots, with a copy to be submitted to the City Development Department staff, and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer construct N. Holly St. to collector street standards with curb, gutter, streetlights and sidewalks as required.

 

12. That the developer dedicate 60 feet of right of way for N Holly street as required.

 

13. That the developer obtain a land disturbance permit for grading, clearing or grubbing activities prior to any construction activities.

 

14. That the developer submit construction plans prior to beginning any work.

 

15.              That the developer obtain a floodplain certificate prior to beginning any construction activities within the floodplain.

 

16.              That the developer show the limits of the 100 year floodplain on the final plat.

 

17.              That the developer show the lowest opening or elevation or minimum low opening of any structure on each lot on the final plat.


A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
