Rezoning an area of approximately 5.3 acres generally located on the north side of N.W. Tiffany Springs Road between N. Hull Avenue and N. Oregon Avenue, from District GP-7 to District GP-5, and approving a development plan for the same. (13401-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A00675, rezoning an area of approximately 5.3 acres generally located on the north side of N.W. Tiffany Springs Road between N. Hull Avenue and N. Oregon Avenue, from District GP-7 (Agricultural and Low Density Residential Uses) to District GP-5 (Medium Density Residential Uses), said section to read as follows:

 

Section 80-11A0675 That an area legally described as:

 

A tract of land in the Northwest Quarter of Section 5, Township 51, Range 33, Kansas City, Platte County, Missouri, being bounded and described as follows: Commencing at the Southwest corner of said Northwest Quarter; thence North 02542 East (North 02558 East), along the West line of said Northwest Quarter, 52.15 feet to the True Point of Beginning of the tract to be herein described; thence continuing North 02542 East (North 02558 East), along said West line, 548.45 feet; thence South 881246 East, 773.02 feet (Deed 772.99) feet to a point on the Northerly right-of-way line of NW Tiffany Springs Road, as now established; thence Southwesterly, along said Northerly right-of-way line, on a curve to the left, having an initial tangent bearing of South 703736 West, a radius of 740.00 feet, an arc distance of 395.20 feet; thence South 400140 West, along said Northerly right-of-way line, 100.03 feet; thence Southwesterly, along said Northerly right-of-way line, on a curve to the right, tangent to the last described course, having a radius of 660.00 feet, an arc distance of 460.93 feet to the True Point of Beginning. Containing 5.21 acres, more or less, except that part on the North and West being used for road right-of-way.

 

is hereby rezoned from District GP-7 (Agricultural and Low Density Residential Uses) to District GP-5 (Medium Density Residential Uses), all as shown outlined on a map marked Section 80-11A0675, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.


Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro/micro storm drainage study to Development Services for approval for the entire development when the first plat is submitted, and that the developer construct any improvements as required by Development Services.

 

3. That the developer dedicate right of way for a secondary arterial as required by the Department of Public Works so as to provide a total of 40 feet of right of way as measured from the centerline of N.W. Tiffany Springs Road.

 

4. That the developer design and construct all interior streets to City Standards as required by the Department of Public Works, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

5. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by the Department of Public Works and that the developer shall be responsible for all costs associated with subordination activities.

 

6. That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, as required by Development Services, prior to recording the plat.

 

7. That the developer submit a street name signage plan for the entire development area for approval by the Street Naming Committee prior to submittal of the first final plat.

8. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

9. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

10. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

11. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by the Department of Public Works.

 

12. That access restrictions be provided to prohibit direct access to N.W. Tiffany Springs Road by any lots and that the restriction be placed on the final plat.

 

13. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of the private open space and for fencing material and heights of fencing along N.W. Tiffany Springs Road and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

14. That the developer extend water mains as required by the Water Services Department.

 

15. That the developer construct hard surface all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond footings and foundations.

 

16. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

17. That the developer construct temporary cul-de-sacs as require by the Department of Public Works.

 

18. That the developer provide for adequate sight distances at all street intersections as required by the City Engineers Office.

 

19. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, signage and grading. The final plan shall include berms, trees and plantings around and within the parking lots; show proposed pedestrian circulation; and include elevation drawings of signage.

 

20. That the developer apply for the vacation of former Tiffany Springs Road as required by the Department of Public Works.

 


Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings required by the Zoning Ordinance have been given and had.
