ORDINANCE NO. 040977

 

Authorizing a $2,165,168.00 Amendment 3 with Burns & McDonnell Engineering Company, Inc. for Contract No. 770, Combined Sewer Overflow (CSO) Long Term Control Plan; and appropriating funding therefore.

 

WHEREAS, the City approved a $36,537.00 contract with Burns & McDonnell Engineering Company, Inc. for the CSO Long Term Control Plan in February 2002; and

 

WHEREAS, Amendment 1 was approved by Ordinance No. 021181 in October 2002 to provide $573,580.00 for a more comprehensive phase of the CSO Long Term Control Plan preparation; and

 

WHEREAS, Amendment 2 was approved by Ordinance No. 031006 in September 2003 to provide $909,862.00 for an expanded public participation program and development of the Sanitary Sewer Overflow (SSO) Control Work Plan in accordance with Resolution No. 030764; and

 

WHEREAS, Amendment 3 includes continued work on the Overflow Control Program (OCP) to develop combined sewer and separated sewer control plans which address wet weather issues in the combined sewer and the separated sewer areas as required by federal and state regulations; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to execute, on behalf of Kansas City, a $2,165,168.00 Amendment 3 to Contract No. 770, CSO Long Term Control Plan, with Burns & McDonnell Engineering Company, Inc. A copy of the contract and amendments are on file in the Water Services Department.

 

Section 2. That the appropriation in the following accounts of the 2004A Sanitary Sewer Revenue Bonds Fund is hereby reduced by the following amount:

 

AL-8179-807790-B Sewers $2,165,168.00

 

Section 3. That the sum of $2,165,168.00 is hereby appropriated from the Unappropriated Fund Balance of the 2004A Sanitary Sewer Revenue Bonds Fund to the following account in the 2004A Sanitary Sewer Revenue Bonds Fund:

 

AL-8179-807769-B Overflow Control Plan $2,165,168.00

 

Section 4. That the Director of Water Services is further authorized to expend up to the sum of $2,165,168.00 to satisfy the cost of this amendment.

 

Section 5. That upon completion of the final costs of this contract, the Director of Finance is hereby authorized to return the unexpended portion of this appropriation to the Unappropriated Fund Balance from which it was derived.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
