ORDINANCE NO. 200371

Releasing a utility easement in Kansas City, Clay County, Missouri, and directing the City Clerk to record this ordinance and attached document.

WHEREAS, the utility easement dedicated via previous plats is no longer needed because there are no utilities located in the easement and this property has not been developed. Further a new utility easement located about 40 feet to the north was dedicated through execution of a Standard Utility Easement to the City and recorded with the Clay County Recorder’s Office as Instrument No. 20200010052, Book 8641 at Page 58. A Minor Subdivision Lot Line Adjustment Plat was recently recorded which reflects the new utility easement and notes that the existing utility easement would be vacated by separate document. Said recording information for this Minor Subdivision Plat is Instrument No. 2020014656 in Book I at Page 100.2; and

WHEREAS, this ordinance is the separate document that will be recorded to release the previous easement that is no longer needed; NOW THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the utility easement dedicated by the following plats located in Kansas City, Clay County, Missouri:

Barry Towne – First Plat recorded June 28, 1995; and
Barry Towne – Second Plat recorded January 26, 1996

and legally described as follows:

All that part of the 10 feet wide tract of land being a portion of the Lot 6, Barry Towne, Second Plat and Lot 5A, Minor Lot Line Adjustment, Lot 4A-1, Barry Towne-First Plat, Replat of Lot 3A, Lot 3B and Lot 4 and Lot 5A, Barry Towne-First Plat, as both are subdivisions in Kansas City, Clay County Missouri lying in the Northeast Quarter of Section 10, Township 51 North, Range 33 West said 10 feet wide tract land lying 5 feet on each side of the following described centerline:

 

Commencing at the Southwest comer of aforesaid Lot 6, also being a point on the Easterly right­ of-way of Madison Avenue, as now established; thence South 50 degrees 24 minutes 59 seconds East, along the South line of said Lot 6, being also along the North line of said Lot 5A and its Westerly extension, a distance of 22.00 feet to a point on the East line of a 10 feet wide Utility easement as recorded in in Document No. M61043 in Book D at Page 94 and the Point of Beginning; thence continuing South 50 degrees 24 minutes 59 seconds East, along the South line of said Lot 6, being also the North line of said Lot 5A, a distance of 196.84 feet to a point on the Westerly line of a 10.00 feet wide Utility Easement dedicated on said Barry Towne, First Plat and the point of termination. This description having been prepared by Stan W. Lloyd, LS#2001024811. Containing 1,968 square feet, more or less.

is hereby released.

Section 2. That upon the effective date of this Ordinance, the City Clerk is hereby directed to cause this Ordinance releasing this easement to be recorded in the office of the Recorder of Deeds for Clay County, Missouri.
