ORDINANCE NO. 080243

 

Approving the preliminary plat of Parkdale Estates on a 6.68 acre tract of land generally located on the east side of N.W. Parkdale Road about 180 feet north of the Kansas City, Missouri city limit and 400 feet south of N.W. 52nd Terrace. (SD 1382)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Parkdale Estates on a 6.68 acre tract of land generally located on the east side of N.W. Parkdale Road about 180 feet north of the Kansas City, Missouri city limit and 400 feet south of N.W. 52nd Terrace, and more specifically described as follows:

 

All of the Northeast Quarter of the Southeast Quarter of Section 31, Township 51 North, Range 33 West, partly in North Kansas City, and wholly in Platte County, Missouri along with all of Lots 134, 135, 136, 140, and 141 of PARKDALE WOODS a subdivision in Platte County, Missouri as recorded in Plat Book 5, Page 14 of the Recorder of Deeds Office for Platte County, Missouri, all being more fully described as follows:

 

Beginning at the Northeast corner of the Northeast Quarter of the Southeast Quarter of Section 31, Township 51 North, Range 33 West, in Platte County, Missouri; thence along the North line of the Northeast Quarter of the Southeast Quarter of said Section 31, North 89 degrees 07 minutes 29 seconds West (this bearing and all following bearings being based on State Plane Grid North and established using R.T.K. G.P.S. equipment, and referenced to Kansas City Metro Control Station PL-68 monument), 1300.68 feet to the Northwest corner of the Northeast Quarter of the Southeast Quarter of said Section 31, and being the Northeast corner of PARKDALE WOODS a subdivision in Platte County, Missouri; thence continue along the North line of the Northwest Quarter of the Southeast Quarter of said Section 31, and being the North line of Lot 141 and 140 of said subdivision North 89 degrees 07 minutes 29 seconds West, 345.80 feet to the Northwest corner of said Lot 140; thence South 63 degrees 00 minutes 35 seconds West, 81.50 (measured), 89.09 feet (plat) to the North Right of Way line of Parkdale Road; thence along the said Right of Way and being the West line of said Lot 140, South 38 degrees 57 minutes 34 seconds East, 25.00 feet to the Southwest corner of said Lot 140; thence along the South line of said Lot 140, North 63 degrees 00 minutes 35 seconds East, 73.45 feet (measured), 75.18 feet (plat); thence continuing along the said South line South 89 degrees 17 minutes 23 seconds East, 144.18 feet (measured), 140.21 feet (plat) to the Southeast corner of Lot 140; thence along the West line of Lot 141 and being the East line of Lots 139, 138 and 137, South 17 degrees 06 minutes 50 seconds East, 186.57 feet to the City Limits of Kansas City, Platte County, Missouri; thence South 89 degrees 07 minutes 29 seconds East, along said City Limits Line, a distance of 1436.32 feet, to the East line of the Southeast Quarter of said Section 31; thence North 00 degrees 43 minutes 21 seconds East, along said East line, a distance of 200.00 feet to the Point of Beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer contribute $233.31 in lieu of parkland dedication for one unit (1 unit [3.7 for single family] .006 $10,509.41 (year 2008) = $233.31) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

3. That the 3:1 depth to width ratio per Section 66-124 of the Subdivision Regulations be waived for Lot 1.

 

4. That the developer secure approval from the Board of Zoning Adjustment for a variance from the minimum 120 feet of street frontage required for property zoned District RA (Agricultural) for Lot 1.

 

5. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to review and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

6. That the developer improve the eastern one half of N.W. Parkdale Road to local street standards as required by Development Services, including curbs, gutters, storm sewers, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

7. That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities.

 

8. That public sanitary sewer system need not be extended provided that the developer demonstrates that the existing private sewage disposal system complies with Chapter 18, Kansas City Building and Rehabilitation Code, Code of Ordinances, at the time of each application for building permits which may add plumbing fixtures.

 

9. That adequate sight distance be provided for the drive connection to N.W. Parkdale Road as required by Development Services.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is

made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
