ORDINANCE NO. 180598

 

Authorizing the Director of Water Services to enter into a Design Agreement with the US Army Corps of Engineers for the design of the Armourdale and Central Industrial District Levee Units Improvements Project and to expend up to $800,000.00 for the City’s local share of the agreement.

 

WHEREAS, Resolution No. 961157, expressed the opinion of the City Council in support of the flood protection projects for the Blue River Channel and Dodson Industrial District, and the study of seven existing levees along the Missouri River; and

 

WHEREAS, Ordinance No. 001083, approved an Agreement between the Department of the Army Corps of Engineers and local levee and drainage districts, including Kansas City, for the joint funding of the Kansas City Flood Damage Reduction Feasibility Effort; and

 

WHEREAS, Ordinance Nos. 011019, 020907, 030793, 040733, and 050536 authorized the funding for Phase 1 for years 2 through 6 for a total of $955,172.00; and

 

WHEREAS, Ordinance No. 120038, authorized the Director of Water Services to execute a Design Agreement with the U.S. Army Corps of Engineers relating to the East Bottoms Levee Reconstruction; and authorizing the expenditure of $119,000.00 for the City's share of the Agreement; and

 

WHEREAS, Ordinance No. 140250, authorized the Director of Water Services to execute an amendment to the design agreement with the US Army Corps of Engineers for the East Bottoms Levee Reconstruction as part of the Kansas City Levees, Missouri and Kansas project and authorized an increased expenditure of $225,000.00 for the City's share of the Agreement; and

 

WHEREAS, Resolution No. 140271, expressed the City’s continued support of the Kansas City’s Levees Project through the US Army Corps of Engineers; and

 

WHEREAS, Resolution No. 170985, established the City of Kansas City’s legislative priorities and position on matters that may come before the 115th United States Congress, 2nd Session, in 2018, including Kansas City’s Levees in partnership with the US Army Corps of Engineers; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to enter into a Design Agreement with the US Army Corps of Engineers for the design of the Armourdale and Central Industrial District Levee Units Improvements Project, Project No 82000037. A copy of the agreement is on file with the Director of Water Services.

 

Section 2. That the Director of Water Services is hereby authorized to expend up to the sum of $800,000.00 to the US Army Corps of Engineers subject to future appropriations, for this purpose.

 

Section 3. That upon completion of the final costs of this agreement, the Director of Finance is hereby authorized to return the unexpended portion of this appropriation to the Fund Balance from which it is derived.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
