ORDINANCE NO. 001220
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0309,
rezoning an area of approximately 6 acres generally located approximately 260
feet north and 160 feet west of the intersection of N.W. 68th Street and N.
Platte Purchase Drive (N. Bell Street) from District R-1a (One-Family
Dwellings) to District C-2-p (Local Retail Business - Limited District), and
approving a preliminary plan for the same. (12389-P)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0309, rezoning an area of
approximately 6 acres generally located approximately 260 feet north and 160
feet west of the intersection of N.W. 68th Street and N. Platte Purchase Drive
(N. Bell Street) from District R-1a (One-Family Dwellings) to District C-2-p
(Local Retail Business - Limited District), said section to read as follows:
Section
80-11A0309. That an area legally described as:
Beginning at a point 165 feet west of the East
Quarter corner of Section 21, Township 51, Range 33, Kansas City, Platte
County, Missouri; thence North 00E32'24"
East, a distance of 89.84 feet; thence South 89E35'03" East, a distance of 150.00 feet to
the point of beginning; thence South 89E35'03"
East, a distance of 125.56 feet to the beginning of a curve to the right having
a radius of 10,500.00 feet; thence eastwardly 190.44 feet along said curve
through a central angle of 01E04'07";
thence South 89E27'36" East, a
distance of 345.00 feet; thence North 00E32'24"
East, a distance of 264.29 feet; thence South 89E49'10" East, a distance of 156.00 feet;
thence North 00E32'24" East, a
distance of 372.97 feet; thence North 89E27'36"
West, a distance of 68.35 feet to the beginning of a curve to the left having a
radius of 300.00 feet; thence southeastwardly along said curve a distance of
471.24 feet; thence South 00E32'24"
West, a distance of 138.23 feet; thence North 89E27'36" West, a distance of 443.86 feet to
the point of beginning of a curve to the right having a radius of 200.00 feet
and an initial tangent bearing of South 02E08'59"
East; thence in a southwardly direction along said curve, a distance of 9.39
feet; thence South 00E32'24" West, a
distance of 66.10 feet; thence South 04E38'32"
West, a distance of 69.89 feet; thence South 00E32'24" West, a distance of 53.67 feet to
the point of beginning. Containing 6.045 acres, more or less.
is
hereby rezoned from District R-1a (One-Family Dwellings) to District C-2-p
(Local Retail Business - Limited District), all as shown outlined on a map
marked Section 80-11A0309, which is attached hereto and made a part hereof, and
which is hereby adopted as a part of an amendment to the zoning maps
constituting a part of said chapter and as an amendment to Section 80-11
thereof.
Section
B. That a preliminary plan for the area legally described above is hereby
approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with Chapter
66, Code of Ordinances of the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval when the first final plat is submitted and
that the developer make any necessary improvements as required by the City
Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer provide for fire protection as required by the Fire Department.
7. That
the developer extend sanitary sewers as required by the Department of Public
Works.
8. That
the developer extend water mains as required by the Water Services Department.
9. That
the developer dedicate additional right of way for N. Platte Purchase Drive as
required by the Department of Public Works so as to provide a total of 40 feet
of right of way as measured from the centerline of N. Platte Purchase Drive.
10. That
the developer improve the west half of N. Platte Purchase Drive to secondary
arterial street standards as required by the Department of Public Works,
including construction of curb, gutter and sidewalks and installation of
streetlights, or enter into an agreement with the City as required by the
Department of Public Works whereby the developer contributes $49,977.98 for the
improvement of N. Platte Purchase Drive based on a rate of $134.00 per front
foot.
11. That
the developer submit a street name signage plan to the Street Naming Committee
for approval prior to the submittal of the first final plat.
12. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for grading, landscaping, screening, berming and signage.
A
copy of said preliminary plan is on file in the office of the City Clerk under
Document No. 001220, which is attached hereto and made a part hereof.
Section
C. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
