ORDINANCE NO. 050936
Authorizing the devotion of City
owned property for public street purposes in connection with the 19th Street construction project from Agnes Avenue west to Kansas Avenue, all in Kansas City, Jackson County, Missouri, and authorizing the city clerk to record this
ordinance.
WHEREAS, Lots 41
and 42, Grahams Addition, Block 2, which is owned by the City of Kansas City,
Missouri (herein called City) is needed as right of way in the construction of
19th Street; and
WHEREAS, the
City devotes a portion thereof for public street purposes as part of 19th Street; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the City hereby devotes a portion of the property for public street purposes as
part of 19th Street, as described below:
A parcel of land
situated in GRAHAMS ADDITION, BLOCK 2, a subdivision of land in the City of Kansas City, Jackson County, Missouri, said parcel being more particularly described as
follows:
All of lots 41 and
42 Grahams Addition, Block 2, containing 7492.5 square feet.
Section 2. That
the City hereby devotes a portion of property as a temporary easement as
described below:
A parcel of land
situated in, SECOND PLAT OF PRESTON PLACE, a subdivision of land in the City
of Kansas City, Jackson County, Missouri, said parcel being more particularly
described as follows:
The south 10 feet of
lots 8 and 12, and the west 10 feet of lot 11, and said lot 12, Second Plat of
Preston Place. Except that part lying in alley and in existing utility
easements, containing 3152 square feet.
The temporary
easements shall be used by the City or its authorized agents, servants,
employees or contractors during the construction for grading and sloping,
removal and replacement of storage sheds, fencing, trees and shrubbery,
sidewalks and driveways, utility construction work, the storage of materials,
the operation of equipment, and the movement of a working force.
The
City shall cause the surface of lands lying within said temporary easement to
be restored to substantially the same physical condition that existed at the
time Kansas City or its agents entered upon it. This Easement is temporary and
shall terminate upon completion and acceptance of the improvements by the
Director of Public Works.
Section 3. That
upon the effective date of this ordinance, the City Clerk is hereby directed to
cause this ordinance to be recorded in the office of the Recorder of Deeds for
Kansas City, Jackson County, Missouri.
