ORDINANCE NO. 150514

 

Repealing Ordinance No. 140270; authorizing condemnation and taking of private property at 2700 Troost Avenue, located on the southwest corner of 27th and Troost; incorporating a blight study and receiving evidence of blight; making a determination of blight; authorizing continued negotiations by the Public Works Department; consenting to the filing of the petition for condemnation by the City Attorney on behalf of the City; and authorizing the City Clerk to cause this ordinance to be recorded in the office of the Recorder of Deeds for Kansas City, Jackson County, Missouri.

 

WHEREAS, there is abundant evidence that the property hereinafter described is a blight on the City of Kansas City, Missouri; and

 

WHEREAS, the Council finds that the subject private property, in the form of must be condemned in fee simple for the public purpose of clearing blight in Kansas City, Jackson County, Missouri;

 

WHEREAS, the Council wishes to repeal the previous ordinance blighting the subject property, and instead make a new determination of blight; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 140270 is hereby repealed.

 

Section 2. That the Council has considered new evidence of blight presented by staff regarding the property hereafter described in Section 4, including a blight study dated May 11, 2015 by Development Initiatives. A copy of this blight study is on file in the Public Works Director’s Office.

 

Section 3. That in accordance with the evidence of blight presented, the Council hereby finds that the property described in Section 4 is blighted.

 

Section 4. That the fee simple interest and all other interests in the following property are hereby authorized condemned and taken to clear blight in and upon the land hereinafter described for redevelopment, in Kansas City, Jackson County, Missouri:

 

2700 a/k/a 2702 Troost Avenue, a/k/a 1015 E. 27th Street (Jackson County Parcel No. 29-810-01-25-00-0-00-000)

 

The East 160 Feet of the North 100 Feet of Block 10, Continuation of Beacon Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, except that part taken for widening Troost Avenue.

 

Section 5. That the property, post blight-clearance, shall be made available by Kansas City for redevelopment in the area of the southwest corner of 27th and Troost in accord with applicable laws and regulations.

 

Section 6. That just compensation for the property taken shall be assessed and paid according to law; and the proceedings to determine compensation shall be prosecuted in one or more suits in the Circuit Court of Jackson County, Missouri, pursuant to the provisions of Chapter 523 of the Revised Statutes of Missouri, as supplemented or amended by Section 86.01 to 86.10 of the Rules of Civil Procedure. Payment of compensation shall be made by Kansas City from funds appropriated for such purposes.

 

Section 7. That pending the acquisition of said property by condemnation, the Director of Public Works is hereby authorized to continue negotiating the purchase of said property and pay for it out of funds appropriated or to be appropriated as aforesaid, and if any tracts be so acquired by negotiation and purchase, the City Attorney is authorized to withdraw same from condemnation proceedings.

 

Section 8. That said property be condemned and conveyed to the City of Kansas City, Missouri.

 

Section 9. That upon the effective date of this ordinance the City Clerk is hereby directed to record this ordinance in the office of the Recorder of Deeds for Jackson County, Missouri.
