COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120311

Authorizing the Director of Public Works to enter into a cooperative agreement with the Kansas City Area Transportation Authority regarding the Westport North section of the Country Club Right-of-Way in Kansas City, Jackson County, Missouri and accepting a right-of-way easement for road purposes and directing the City Clerk to record the easement.

WHEREAS, in October of 1981, the Kansas City Area Transportation Authority purchased fee simple interest in a railroad right-of-way extending a distance of approximately 7.41 miles and running from the south curb line of Westport Road at Mill Street to the center line of Prospect Street south of 85th Street for the sum of $1,500,000.00; the funding for which came from the City; and

WHEREAS, this right-of-way has come to be commonly referred to as the Country Club Right-of-Way; and

WHEREAS, the City has an interest in acquiring an easement for road purposes on that northernmost portion of the Country Club Right-of-Way commonly referred to by the Kansas City Area Transportation Authority as the Westport North section which abuts Westport Square and which is located generally between Westport Road on the north and 42nd Street on the South; and

WHEREAS, the Council finds that it is for the public good to accept the easement on this northernmost portion of the Country Club Right-of-Way commonly referred to by the Kansas City Area Transportation Authority as the Westport North section; and

WHEREAS, upon acceptance of the easement, the City desires to operate and maintain a roadway on the existing driveway and parking improvements; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Public Works is authorized to enter into a cooperative agreement with the Kansas City Area Transportation Authority and to accept an easement to operate and maintain a roadway on the existing driveway and parking facility located in the northernmost portion of the Country Club Right-of-Way commonly referred to by the Kansas City Area Transportation Authority as the Westport North section which abuts Westport Square and which is located generally between Westport Road on the north and 42nd Street on the South, all within Kansas City, Jackson County, Missouri, a copy of which is attached hereto and incorporated by reference.


Section 2. That the City Clerk is hereby directed to record the easement and a copy of this ordinance in the office of the Director of Records for Jackson County, Missouri, as evidence of the acceptance of the property described therein by the City.
