Approving an amendment to a
previously approved Chapter 80 preliminary development plan for a 3.36 acre
property at N.W. Harlem Road and N. Main Street in Districts M1-5 to allow for
the construction of a single story warehouse. (7300-P-6)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That an
amendment to a previously approved Chapter 80 preliminary development plan in
District M1-5 (Manufacturing 1 (dash 5)) on a 3.36 acre tract of land generally
located at the northwest corner of N.W. Harlem Road and N. Main Street, and
more specifically described as follows:
114 NW Harlem Road,
Harlem Lots 15 and 16, Block 2.
Harlem Lots 1-8,
Block 2, Lots 9-14 and west 40 feet Lots 15 and 16, Block 3 and vacated N.
Baltimore Avenue.
16 NW Harlem
Road/east 40 feet of west 80 feet Lots 15 and 16, Block 3, Harlem
12 NW Harlem
Road/vacated lot Harlem east 50 feet of Lots 15 and 16, Block 3.
is hereby approved, subject to
the following conditions:
1.
That the developer provide landscaping in compliance with Section 88-425
“Landscaping and Screening.”
2.
That the developer meet the requirement of Chapter 52 for parking and
drive aisles.
3.
That the developer remove fencing from the north/south alley next west
of vacated N. Baltimore Avenue or vacate the alley and provide an easement to
landlocked property owner.
4.
That the developer submit a Chapter 80 Final Plan for approval.
5.
That the developer submit a storm drainage analysis from a
Missouri-licensed civil engineer to the Land Development Division, in
accordance with adopted standards, including a BMP level of service analysis
prior to approval and issuance of any building permits, and that the developer
secure permits to construct any improvements as required by the Land
Development Division prior to issuance of any certificate of occupancy.
6.
That the owner/developer submit plans for grading, siltation, and
erosion control to Land Development Division for review and acceptance, and
secure a site disturbance permit for any proposed disturbance area equal to one
acre or more prior to beginning any construction activities.
7.
That the developer submit an analysis to verify adequate capacity of the
existing sewer system as required by the Land Development Division prior to
issuance of a building permit to connect a private system to the public sewer
main and depending on adequacy of the receiving system, make other improvements
as may be required.
8.
That the developer grant a BMP Easement to the City as required by the
Land Development Division, prior to recording the plat or issuance of any
building permits.
9.
That the proposed development is located in an area where the Charles B.
Wheeler Downtown Airport height zoning restrictions apply. No structure in this
area should be constructed which exceeds these restrictions.
10.
That the proposed project location is in proximity to the Charles B.
Wheeler Downtown Airport Part 77 Horizontal Surface with an approximate elevation
of 908 feet.
11.
That this proposed development needs to review and comply with the
City’s Airport height zone Ordinance No. 040342 and
associated maps.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section B. That the Council finds and
declares that before taking any action on the proposed amendment hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
