COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120753

 

Approving the plat of Antioch Crossing, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways; accepting certain lands for park purposes forever, in accordance with Section 1004 of Article X of the Charter of Kansas City; authorizing the Director of City Development to execute and/or accept certain agreements; authorizing the Director of Public Works to execute a certain agreement; and authorizing the City Clerk to record this ordinance and attached documents. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Antioch Crossing, a subdivision in Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference, is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That all right, title and interest in the following recorded easements be and the same are hereby released to the respective owners, their successors or assigns, over that part of aforesaid easement under the following. These releases do not become effective until the final plat is recorded.

Section 4. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

 

Section 5. That the lands heretofore designated and selected by the Board of Park and Recreation Commissioners as evidenced by their Resolution No. 29883 duly adopted on August 7, 2012, for public use for park purposes, to‑wit:

 

All that part of Lots 1, 3, 3A, 4, 6, 9, 10 and 12, Block 1, Resurvey Of Blocks 1 And 3, Antioch, a subdivision of land in the Northwest Quarter and the Southwest Quarter of Section 31, Township 51 North, Range 32 West of the 5th Principal Meridian in Kansas City, Clay County, Missouri being bounded and described as follows: Beginning at the Northwest corner of said Lot 1, being also a point on the Southwesterly right-of-way line of Chouteau Trafficway, as now established, thence Southeasterly, along said right-of-way line, along a curve to the right, having an initial tangent bearing of South 75 degrees 23 minutes 30 seconds East, with a radius of 2,663.81 feet, a central angle of 14 degrees 26 minutes 54 seconds, and an arc distance of 671.73 feet; thence Southeasterly, continuing along said right-of-way line, along a curve to the right, having a common tangent with the last described course, with a radius of 661.16 feet, a central angle of 76 degrees 12 minutes 58 seconds and an arc distance of 879.49 feet; thence South 15 degrees 16 minutes 22 seconds West, continuing along said right-of-way line, 350.83 feet; thence Southerly, continuing along said right-of-way line, along a curve to the left, being tangent to the last described course, with a radius of 1,526.80 feet, a central angle of 27 degrees 13 minutes 19 seconds and an arc distance of 725.40 feet; thence South 11degrees 56 minutes 57 seconds East, continuing along said right-of-way line, 15.22 feet to a point on the Northwesterly right-of-way line of U.S. Highway No. 69 (Vivion Road), as now established; thence Westerly, along said right-of-way line, along a curve to the left, having an initial tangent bearing of South 75degrees 41 minutes 46 seconds West with a radius of 1,472.70 feet, a central angle of 00 degrees 23 minutes 22 seconds and an arc distance of 10.01 feet; thence North 11 degrees 56 minutes 57 seconds West, 15.67 feet; thence Northerly, along a curve to the right, being tangent to the last described course, with a radius of 1,536.80 feet, a central angle of 27 degrees 13 minutes 19 seconds and an arc distance of 730.15 feet; thence North 15 degrees 16 minutes 22 seconds East, 350.83 feet; thence Northwesterly, along a curve to the left, being tangent to the last described course, with a radius of 651.16 feet, a central angle of 76 degrees 12 minutes 58 seconds and an arc distance of 866.19 feet; thence Westerly, along a curve to the left, having a common tangent with the last described course, with a radius of 2,653.81 feet, a central angle of 14 degrees 24 minutes 25 seconds and an arc distance of 667.30 feet to a point on the Westerly right-of-way line of said Lot 1; thence North 03 degrees 47 minutes 19 seconds East, along said Westerly line, 10.18 feet to the Point of Beginning. Containing 26,364 square feet or 0.61 acres, more or less.

 

Containing .61 acres, more or less be and the same is hereby accepted for public use for park purposes and shall remain such forever in accordance with Section 1004 of Article X of the Charter of Kansas City.

 

Section 6. That the Director of Public Works is hereby authorized to execute a Cooperative Agreement with Public Works to Contribute Full Cost of Installing Pedestrian Facilities and Traffic Signals Agreement, to be in a form substantially as that attached hereto as Exhibit A and incorporated herein by reference.

 

Section 7. That the Director of City Development is hereby authorized to execute and/or accept any and all agreements necessary to clear the title of any right of way, utility easements or other public property dedicated on the plat.

 

Section 8. That the City Clerk is hereby directed to record copies of this ordinance, together with the documents described herein and all other relevant documents, when the plat has been released for recording in the Office of the Recorder of Deeds of Clay County, Missouri.

 

Section 9. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
