ORDINANCE NO. 940003
Declaring the area located at 2023 Benton Boulevard a
blighted and insanitary area in need of redevelopment and rehabilitation
pursuant to the Missouri Land Clearance for Redevelopment Authority Law and
approving an amendment to the Urban Renewal Plan for the Infill Housing Urban
Renewal Project Area No. 35.
WHEREAS, Section 99.430, Revised Statutes of
Missouri, 1986, as amended, provides that an Urban Renewal Plan may be approved
simultaneously with the declaration of the blight; and
WHEREAS, Ordinance No. 910861, approved August 8,
1991, declared an area at 2025 Benton Boulevard a blighted and insanitary area
and approved an Urban Renewal Plan for such area known as Urban Renewal Project
Area No. 35; and
WHEREAS, it has been determined that it is
appropriate to extend the boundaries of the Urban Renewal Area; and
WHEREAS, the Land Clearance for Redevelopment
Authority of Kansas City, Missouri, did on September 29, 1993, adopt a
resolution approving an Urban Renewal Plan Amendment for Infill Housing Urban
Renewal Project No. 35 to include 2023 Benton Boulevard and declare such area a
blighted area; and
WHEREAS, the City Plan Commission has reviewed and
recommended approval of the Urban Renewal Plan and expansion of blight on
December 7, 1993, and has found said plan to be in conformance with the Master
Plan of the development of the community as a whole as evidenced by its
resolution recommending the adoption of said plan and declaration of blight, a
copy of which is attached hereto and incorporated as Exhibit "A";
NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section 1. That an area located at 2023 Benton
Boulevard, more specifically described as:
Lot 3, and the west 1/2 of the vacant alley east of
and adjacent, W.H. COLLIN 2ND ADDITION, Kansas City, Jackson County,
Missouri.
a blighted and insanitary area and need of rehabilitation
and redevelopment and appropriate for an Urban Renewal Project as contemplated
by Section 99.430, Revised Statutes of Missouri, 1986.
Section 2. That this Council has duly made the
findings necessary for compliance with Sections 99.320 and 99.430, Revised
Statutes of Missouri, 1986.
Section 3. That an amendment to Urban Renewal Plan
for Infill Housing Urban Renewal Project No. 35, 2025 Benton Boulevard, a copy
of which is on file in the office of the City Clerk under Document No. 940003
and which is incorporated herein by reference to include property at 2023
Benton Boulevard is hereby approved.
Section 4. That said Urban Renewal Plan is hereby
found to be feasible and in conformance with the Master Plan for the
development of the community as a whole.
