ORDINANCE NO. 060151
Authorizing and accepting a real
estate exchange agreement with Donaldson Properties, LTD, a Texas Limited
Partnership under which the City desires to exchange properties necessary for
the building of a new Fire Station #41 located in Kansas City, Jackson County,
Missouri; and authorizing the City Clerk to record this ordinance and
agreement.
WHEREAS, said Donaldson Properties, LTD owns property
located in the vicinity of 93rd Street and Hillcrest Road; and
WHEREAS, the City has entered into a real estate exchange
agreement with Donaldson Properties, LTD, for the construction of Fire Station
#41; and
WHEREAS, the City needs to acquire portions of this
property on which the Project is to be constructed, and
WHEREAS, in exchange for said property by the City from
Donaldson Properties, LTD, the City has agreed to exchange certain property
that it owns in the area of 5700 E. Bannister Road thus ensuring the
construction of said Fire Station; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of City Development is hereby authorized to execute a real estate
exchange agreement with Donaldson Properties, LTD for the conveyance of the
property at 5700 E. Bannister Rd. by the City to Donaldson Properties and the
conveyance of the property described in Exhibit B of the agreement by
Donaldson Properties to the City. The agreement is approved in substantial
form as that attached to the original of this ordinance.
Section 2. That
the Director of City Development, is authorized to execute all necessary documents
to convey the property, owned by the City and described as follows, to
Donaldson Properties, LTD:
A
tract of land in the Southeast Quarter of the Northeast Quarter of Section 26,
Township 48, Range 33 West, in Kansas City, Jackson County, Missouri, more
particularly described as follows:
Beginning
on the north line of Bannister Road at a point 40.0 feet north of a point in
the south line of the Southeast Quarter of the Northeast Quarter of Section 26,
Township 48, Range 33, said point being 350.0 feet west of the southeast corner
of said Quarter-Quarter Section, thence north parallel to the east line of said
Quarter-Quarter Section, a distance of 250.0 feet, thence west parallel to the
south line of said Quarter-Quarter a distance of 125.0 feet, thence south
parallel to the east line of said Quarter-Quarter Section a distance of 250.0
feet to a point 40.0 feet north of the south line of said Quarter-Quarter
Section, thence east on a line parallel to the said south line a distance of
125.0 feet to the point of beginning and containing approximately 31,250 square
feet.
Section 3. That upon the effective
date of this ordinance, the City Clerk is hereby directed to cause the
ordinance and the attached Real Estate Exchange Agreement to be recorded in the
office of the Recorder of Deeds of Jackson County, Missouri.
