Approving
an amendment to a previously approved development plan in District GP-1 (General
Industry) on approximately a 39.4 acre tract of land generally located on the
west side of N.W. Prairie View Road, south of N.W. Tiffany Springs Road, east
of N. Congress Avenue, and on the north side of N. Donovan Drive, for the
purpose of deleting an approximately 2.5 acre tract of land from said
development plan. (5935-GP-10)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved development plan in District
GP-1 (General Industry) on approximately a 39.4 acre tract of land generally
located on the west side of N.W. Prairie View Road, south of N.W. Tiffany
Springs Road, east of N. Congress Avenue, and on the north side of N. Donovan
Drive, and more specifically described as follows:
That part of the Southeast Quarter of Section 1,
Township 51 North, Range 34 West of the 5th P.M. Kansas City, Platte County,
Missouri described as follows: Beginning at the point of intersection of the
southerly right of way line of N.W. Tiffany Springs Road and the west line of
said Southeast Quarter being 30 feet south of the northwest corner of said
Southeast Quarter; thence south on said west line, 1423 feet more or less to
the westerly prolongation of the south line of Lot 1, The Lakes Executive
Hills North, a subdivision of land in Kansas City, Platte County, Missouri;
thence east on said westerly prolongation, 370 feet, more or less, to the
southwest right of way line of said Donovan Drive; thence easterly on said
southerly right of way line to the northeast corner of said Lot 1; also being
a point on the south line of Lot 2, Barron International Plaza, a subdivision
of land in Kansas City, Platte County, Missouri; thence east on said south
line 210 feet to the southeast corner of said Lot 2; thence north on the
easterly line of said Lot 2, 313 feet to the southerly line of said Lot 2;
thence easterly on said southerly line, 190 feet, more or less, to a point on
right of way line, 159 feet, more or less, to the southerly right of way line,
28 feet, more or less, to the westerly right of way line of said Interstate
Highway 29; northwesterly on said westerly right of way line to the southerly
right of way line of said N.W. Tiffany Springs Road; thence westerly on said
southerly right of way line to the point of beginning. Tract contains 41.5
acres, more or less.

of land in the City of Kansas City, Platte County, Missouri, described as
follows: Beginning at the southeast corner of said Lot 2; thence North 89E57'34" West, along the south line of
said Lot 2, a distance of 210.00 feet; thence North 00E16'03" East, along a line parallel
with the east line of said Lot 2, a distance of 335.66 feet to a point on the
north line of said Lot 2, said point also being on the southerly right of way
line of Donovan Drive; thence easterly along said northerly line of said Lot
2, also being the southerly right of way line of Donovan Drive, along a curve
to the left, having an initial tangent bearing of North 83E04'58" West, and a radius of 449.47
feet, an arc distance of 250.46 feet; thence
North 64E59'25" East, along the above described line, a distance of 214.89
feet, to a point on the westerly right of way line of U.S. Interstate Highway
Route No. I-29; thence South 14E11'02" West, along the
westerly, right of way line of U.S. Interstate Highway Route No. I-29, a
distance of 157.46 feet, to the southerly line of said Lot 2; thence North 89E57'34" West, along the south line of said Lot 2, a distance of
190.42 feet to the easterly line of said Lot 2; thence South 00E16'03" West along the westerly line of said Lot 2, a distance of

of beginning, thence easterly and southeasterly along a curve to the right with
a radius of 740 feet, an arc distance of 139 feet, thence southeasterly along a
line tangent to the last described course, a distance of 9 feet, thence
easterly along a curve to left, being tangent to the last described course,
having a radius of 1460 feet, an arc distance of 730 feet to a point on the
westerly right of way line of Interstate No. 29, thence northerly and
northwesterly along said westerly right of way line of Interstate No. 29 to the
intersection of said westerly right of way line of Interstate No. 29 and said
southerly right of way line of N.W. Tiffany Springs Road, thence northwesterly
and westerly along said southerly right of way line of N.W. Tiffany Springs
Road to the point of beginning. (Excepted Parcel contains 2.5 acres, more or

along the westerly line of said Lot 1, The Lakes Executive Hills North, 707
feet, more or less, to the southerly right of way line of N.W. Donovan Drive,
thence easterly along said southerly right of way line of N.W. Donovan Drive to
the westerly right of way line of Interstate Highway 29, thence northerly along
said westerly right of way line of Interstate Highway 29, 296 feet, more or
less, to the northeast corner of Lot 1, Barron International Plaza, a
subdivision of land in Kansas City, Platte County, Missouri, thence westerly
along the north line of said Lot 1, Barron International Plaza, 260 feet, more
or less, thence northwesterly along the north line of said Lot 1, Barron International
Plaza, 388 feet, more or less, thence northwesterly along a curve to the right,
having a radius of 1460 feet, an arc distance of 730 feet, more or less, thence
northwesterly tangent to the last described course a distance of 9 feet, more
or less, thence westerly along a curve to the left being tangent with the last
described course with a radius of 740 feet, an arc distance of 139 feet, more
or less, to the southerly right of way line of N.W. Tiffany Springs Road,
thence westerly along the southerly right of way line of said N.W. Tiffany
Springs Road to the point of beginning. (Said Parcel contains 36.9 acres, more
or less.)
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any improvements as required by the City
Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer dedicate additional right of way for N. Congress Avenue as
required by the Department of Public Works so as to provide a total of 40 feet
of right of way as measured from the centerline of N. Congress Avenue.
6. That
the developer improve one-half of N. Congress Avenue to secondary arterial
street standards as required by the Department of Public Works.
7. That
the developer dedicate additional right of way for Tiffany Springs Road as
required by the Department of Public Works so as to provide a total of 40 feet
of right of way as measured from the centerline of Tiffany Springs Road.
8. That
the developer improve one-half of Tiffany Springs Road to secondary arterial
street standards as required by the Department of Public Works.
9. That
the developer secure permits for construction of sidewalks along N.W. Avion
Avenue as required by the Department of Public works prior to issuance of
building permits along that frontage.
10. That
the developer provide for fire protection as required by the Fire Department
prior to construction beyond foundations.
11. That
the developer secure the approval of the Missouri Department of Transportation
prior to working within any State right of way.
12. That
the developer comply with the Kansas City International Airport Height Zoning
restrictions and that such restrictions be included on the final plat.
13. That
the developer grant an Aviation Noise Easement for each phase to the City and
file same with each final plat as required by the Aviation Department.
14. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for grading, landscaping, screening, berming, lighting and
signage.
A
copy of said development plan is on file in the office of the City Clerk under
Document No. 021404, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
