ORDINANCE NO. 120282

 

Authorizing condemnation, taking private property in fee simple for public use in the area bounded by Brooklyn and Prospect Avenues, and 26th and 27th Streets, all in Kansas City, Jackson County, Missouri; providing for the payment of just compensation therefore; authorizing continued negotiations and purchase by the Capital Projects Department; authorizing the filing of the petition for condemnation by the City Attorney on behalf of the City; and directing the City Clerk to record this ordinance in the office of the Recorder of Deeds for Jackson County, Missouri.

 

WHEREAS, the Council finds that private property must be condemned for the construction and maintenance of a patrol station and crime lab known as East Police Campus, in Kansas City, Jackson County, Missouri; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the private properties in fee simple are hereby authorized condemned and taken for public use in and upon the land hereinafter described for East Patrol Campus, Project No. 0700-0168, including any necessary appurtenances, in Kansas City, Jackson County, Missouri.

Section 2. That the private properties to be condemned and taken for public use are legally described as follows:

 

Tract 61-2640 Olive

 

Lot 4, except the south 5 feet thereof, Block 2, Towt’s Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

Tract 63-2601 Olive

 

All that part of lots 107 and 108, in Belmont; That part of Lot A in Ashcroft Addition, (both being subdivisions in Kansas City, Jackson County, Missouri); that part of vacated Lockridge Road, and that part of vacated alley east of and adjoining said lots 107 and 108, all described as follows: Beginning at the southeast corner of 26th and Olive Streets; thence south 40 feet along the east line of Olive Street; thence east 135.25 feet to the center line of a vacated alley; thence north 40 feet to the south line of 26th Street; thence west along the south line of 26th Street, 135.25 feet to the place of beginning.

 

Tract 64-2603 Olive

 

The south 20 feet of Lot A, Ashcroft Addition, and the south 10 feet of lot 107, all of lot 106 the north 2.9 feet of lot 105 and the west ½ of vacated alley east of and adjoining Belmont,; the north 18.5 feet of lot 17 except the west 70 feet of the south 1 foot thereof. Block 1, The Summit, an addition, and that part of Lockridge Road lying between the aforesaid tracts, all being subdivisions in Kansas City, Jackson County, Missouri.

 

Tract 65-2605 Olive

 

Parts of Lots 15, 16, 17, Block 1 The Summit, and Lots 104 and 105, Belmont (both being subdivisions in Kansas City, Jackson County, Missouri), and vacated Lockridge Road, described as: Beginning 7.5 feet north of the southwest corner of said Lot 17, The Summit; thence south 45 feet; thence east and parallel to the south line of said Lot 15, The Summit, to the west line of alley east of said Lot 104, Belmont; thence north to a point 22.1 feet north of the southeast corner of said Lot 105, Belmont; thence west parallel to the south line of said Lot 105, to a point 70 feet east of the west line of said Lot 17, The Summit; thence north 1 foot; thence west to the point of beginning, all in Kansas City, Jackson County, Missouri.

 

Tract 66-2607 Olive

 

All of Lot 14 and the south half of Lot 15, in Block 1 The Summit, also that part of Lot 104 Belmont (both being subdivisions in Kansas City, Missouri), adjoining on the east, and part of the vacated Lockridge Road between said lots: also the west ½ of vacated alley east of and adjoining in Kansas City, Missouri;

 

Tract 67-2609 Olive

 

All of Lot 13 and the north ½ of Lot 12, Block 1, The Summit, an addition in Kansas City, Missouri, according to the recorded plat thereof, also all that part of what was formerly known as Lockridge Road described as follows: Beginning at the northeast corner of said lot 13, thence east 13.29 feet; thence south 25 feet to the southeast corner of said lot 13; thence northwesterly along the easterly line of said Lot 13, to the beginning.

 


Tract 83-2618 Wabash

 

Part of Lots 97 and 98, in Belmont, and parts of Lots 2 and 3, Block 1, in the Summit, both being subdivisions in Kansas City, Jackson County, Missouri, and part of the vacated street or road, lying between said tracts, all more particularly described as follows: Beginning on the west line of Wabash Avenue, 88 feet north of the south line of Lot 101, Belmont; thence north 32 feet; thence west 135.25 feet; thence south 32 feet; thence east 135.25 feet to the point of beginning.

 

Tract 103-2635 Wabash

 

Lot 44 and the south 5 feet of Lot 45, Belmont, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

Tract 105-2641 Wabash

 

All of Lots 40 and 41 in Belmont; a part of Lot A, Towt’s Addition, both additions in Kansas City, Jackson County, Missouri; a part of vacated Lockridge Road, more particularly described as follows: Beginning at a point on the east line of Wabash Avenue, 54.8 feet north of the intersection of said east line with the north line of 27th Street; thence east 128 feet to the southeast corner of said Lot 40, Belmont; thence north 50 feet to the northeast corner of said Lot 41, Belmont; thence west 128 feet to northwest corner of said Lot 41, Belmont; thence south along the east line of said Wabash Avenue to beginning, excepting an area in the southeast corner of lot 40, described as follows: Beginning at the southeast corner of the east line of said Lot 40, thence north 25 feet along the said east line of Lot 40; thence west 10 feet; thence due south 25 feet; thence due east to point of beginning, said tract having an area of 10 feet by 25 feet in the southeast corner of said Lot 40, Belmont Addition.

 

Tract 113-2610 Prospect

 

All of lot 19, Belmont, a subdivision in Kansas City, Jackson County, Missouri, except the east 5 feet in Prospect Avenue, according to the recorded plat thereof.

 

Tract 124-2644 Prospect

 

The south 15 feet of Lot 35 and all of Lots 36 and 37, Belmont, a subdivision in Kansas City, Jackson County, Missouri, except part in Prospect Avenue, according to the recorded plat thereof.

 


Tract 126-2412 E 27th St

 

The south 50.2 feet of Lot 5, Block 1, Towt’s Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

Tract 127-2615 Wabash

 

The south 16 2/3 feet of Lot 54 and the north 16 2/3 feet of Lot 53, Belmont, a subdivision in Kansas City, Jackson County, Missouri.

Section 3. That just compensation for the property taken shall be assessed and paid according to law; and the proceedings to determine compensation shall be prosecuted in one or more suits in the Circuit Court of Jackson County, Missouri, pursuant to the provisions of Chapter 523 of the Revised Statutes of Missouri, as supplemented or amended by Section 86.01 to 86.10 of the Rules of Civil Procedure. Payment of compensation shall be made by Kansas City from funds appropriated for such purposes.

Section 4. That pending the acquisition of said lands by condemnation, the Director of the Capital Projects Department is hereby authorized to negotiate the purchase of said land and pay for them out of funds appropriated or to be appropriated as aforesaid, and if any tracts be so acquired by negotiation and purchase, the City Attorney is authorized to withdraw same from condemnation proceedings.

Section 5. That said tracts be condemned and conveyed to Kansas City, Missouri, in fee simple.

Section 6. That upon the effective date of this ordinance, the City Clerk is hereby directed to record this ordinance in the office of the Recorder of Deeds for Jackson County, Missouri.
