ORDINANCE NO. 180886

 

Amending Committee Substitute for Ordinance No. 140597 by repealing and reenacting Section 2 for the purposes of revising the legal description of Redevelopment Project Area 1 of the Bannister & I-435 Tax Increment Financing Plan, as amended; and directing the City Clerk to transmit copies of this ordinance.

 

WHEREAS, pursuant to the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statutes of Missouri, as amended (the “TIF Act”), the City Council of Kansas City, Missouri created the Tax Increment Financing Commission of Kansas City, Missouri (the "Commission"); and

 

WHEREAS, the City Council approved the Bannister & 1-435 Tax Increment Financing Plan by Committee Substitute for Ordinance No. 130737, passed on October 10, 2013; and

 

WHEREAS, the City Council subsequently approved the First Amendment to the Bannister & 1-435 Tax Increment Financing Plan (the Bannister & 1-435 Tax Increment Financing Plan as amended by the First Amendment to the Bannister & 1-435 Tax Increment Financing Plan is referred to herein as the "Redevelopment Plan") and designated the Redevelopment Area as a blighted area; and

 

WHEREAS, the Redevelopment Plan contemplates the implementation of the improvements described therein through several Redevelopment Projects; and

 

WHEREAS, on December 15, 2016, the City Council passed Committee Substitute for Ordinance No. 140597 which approved and designated Redevelopment Project Area 1 of the Redevelopment Plan as a Redevelopment Project and adopted tax increment allocation financing therein; and

 

WHEREAS, the developer of the Redevelopment Plan (as designated by the Commission), Jackson County and the Commission have determined that the legal description for Redevelopment Project Area 1 requires revision due to subsequent replatting within the Redevelopment Area and such revisions do not alter the boundaries of the Redevelopment Project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Committee Substitute for Ordinance No. 140597 is hereby amended by repealing Section 2 and enacting a new Section 2 in its place, to read as follows:

 

Section 2. Effective as of the original effective date of Committee Substitute for Ordinance No. 140597, the following described area is hereby designated as Redevelopment Project Area 1 of the Bannister & I-435 Tax Increment Financing Plan, legally described as follows: 

 

Lot 1, Cerner Trails Campus First Plat, a subdivision in Kansas City, Jackson County, Missouri.

 

Section B. That the City Clerk shall send copies of this ordinance to the County Clerk and County Executive of Jackson County, Missouri.
