COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 080350

Authorizing the Director of Public Works to enter into an agreement with the Kansas City Area Transportation Authority (KCATA) for KCATA to provide regular transit services and to administer the Share-A-Fare program; and authorizing the expenditure of funds previously appropriated in an amount not to exceed $29,800,800.00.

WHEREAS, KCATA and the City enter into an annual agreement for regular transit service and Share-A-Fare program administration; and

WHEREAS, KCATA is initiating a review of its Share-A-Fare program and will be recommending changes to that program; and

WHEREAS, the manner in which the Share-A-Fare program is implemented is a matter in which the City has a vital interest as it provides needed transportation services for elderly persons and persons with disabilities, and specialized reverse commute transportation services for residents of the City; and

WHEREAS, it is important that the City Council have the opportunity to review and comment on the recommended changes before implementation by KCATA; and

WHEREAS, it is also imperative that KCATA continue to work and collaborate with the City on the Citys ongoing efforts to develop a light rail system; and

WHEREAS, an agreement with KCATA must address these vital city issues; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section 1. That the Director of Public Works is hereby authorized to enter into an agreement, on behalf of the City, with the Kansas City Area Transportation Authority to provide funding for the Share-A-Fare program which provides transportation for elderly persons and persons with disabilities and specialized reverse commute transportation services for residents of Kansas City, Missouri, for a period of one year beginning May 1, 2008 through April 30, 2009, and which contains provisions for City review of any proposed changes to the Share-A-Fare program and affirms KCATAs commitment to the Citys light rail efforts. The agreement is in a form substantially similar to the attached agreement incorporated herein by reference.

  Section 2. That the Director of Public Works is hereby authorized to expend an amount not to exceed $29,800,800.00 from funds previously appropriated to the following accounts in the 2008-2009 Budget and not to exceed the amount of the funds so budgeted:


09-2080-692000-F KCATA Operations $ 6,537,447.00

09-2290-692000-F KCATA Sales Tax 23,263,353.00

TOTAL $29,800,800.00

  I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
