SUBSTITUTE FOR ORDINANCE NO. 080193
Approving the Petition to
Establish the Shoal Creek Valley Community Improvement District; establishing
the Shoal Creek Valley Community Improvement District generally bounded by the
Shoal Creek Valley Golf Course on the north, North 76th Street on the south,
Shoal Creek Parkway on the west and Flintlock Road on the east in Kansas City,
Clay County, Missouri; and directing the City Clerk to report the creation of
the District to the Missouri Department of Economic Development.
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That,
with the understanding that any special assessment levied against the benefited
real property located within the Shoal Creek Valley Community Improvement
District (the District) shall be in relation to the benefit conferred upon each
respective tract, lot or parcel of real property and the cost to provide such
benefit, the Petition to establish the District as a political subdivision in
accordance with Section 67.1401 through Section 67.1571, RSMo, otherwise known
as the Missouri Community Improvement District Act (the Act), is hereby
approved in its entirety.
Section 2. That
the District is hereby established for the purposes set forth in the Petition
and shall have all the powers and authority authorized by the Petition, the
Act, and by law, and shall continue to exist and function for a minimum period
of 30 years from the effective date of this Ordinance.
Section 3. That
the District shall annually submit its proposed budget, report and copies of
written resolutions passed by the Districts board to the City pursuant to
Section 67.1471, RSMo.
Section 4. That
upon the effective date of this Ordinance, the City Clerk is hereby directed to
report the creation of the District to the Missouri Department of Economic
Development pursuant to Section 67.1421.6, RSMo, by sending a copy of this
ordinance to said agency.
