COMMITTEE SUBSTITUE FOR ORDINANCE NO. 050163

 

Approving the preliminary plat of Atriums East at Soho West on an approximately 0.72 acre tract of land generally located at 607-609 Central Street (north side of 7th Street between Wyandotte Street and Central Street). (SD 1130B).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Atriums East at Soho West on an approximately 0.72 acre tract of land generally located at 607-609 Central Street (north side of 7th Street between Wyandotte and Central Street), and more specifically described as follows:

 

All that part of Block 10, Hubbards Addition to the City of Kansas which lies South of a line drawn 1 foot North of the South line of Lot 74 of said Block 10, Hubbards Addition, except the East 5 feet thereof said Block 10 now in Wyandotte Street, also including all of Lots 1 through 6, inclusive, Dobson and Douglass Subdivision of Lot 71 and the 25 feet of Lot 72, Block 10, Hubbards Addition to the City of Kansas, each now being subdivisions in Kansas City, Jackson County, Missouri, according to the recorded plats thereof, being more particularly described as follows:

 

Beginning at the Southwest corner of said Lot 6 being also the intersection of the Northerly right-of-way line of West 7th Street with the Easterly right-of-way line of Central Street, as said streets are now both established; thence North 02 degrees 15 minutes 51 seconds East along the Easterly right-of-way line of said Central Street, being also along the Westerly line of said Lot 6 and along the Westerly line of said Block 10, a distance of 181.21 feet (181 feet, Plat), more or less, to a point 1 foot North of the South line of said Lot 74, as measured perpendicular to the South line thereof; thence South 87 degrees 26 minutes 06 seconds East along a line 1 foot North of and parallel with the South line of said Lot 74, a distance of 171.47 feet (171 feet, Plat), more or less, to a point on the Westerly right-of-way line of Wyandotte Street, as now established 5 feet West of the East line of said Block 10; thence South 2 degrees 16 minutes 00 seconds West along the Westerly right-of-way line of said Wyandotte Street, being also along a line 5 feet West of and parallel with the East line of said Block 10, a distance of 181.26 feet (181 feet, Plat), more or less, to the Southeast corner of said Lot 1, being also a point on the Northerly right-of-way line of said West 7th Street; thence North 87 degrees 25 minutes 00 seconds West along the Southerly line of said Lots 1 through 6, inclusive, being also along the Northerly right-of-way line of said West 7th Street, a distance of 171.46 feet (171 feet, Plat), more or less, to the Point of Beginning. Containing 31,075 square feet or 0.713 acres, more or less.

 

is hereby approved subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Department of Public Works in accordance with Chapters 56 and 64 of the Code, prior to recording of the plat.

 

3. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas and private open space tract.

 

4. That the developer contribute $6,113.29 in lieu of parkland dedication for 48 units (48 units X 2 X .006 = .576 acres - .098 (private open space credit) X $12,789.30 (year 2004)) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, as required by the Subdivision Regulations all public notices have been given and hearing have been held.
