ORDINANCE NO. 950372

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2579, rezoning an area of approximately 7.65 acres generally located north of Bernard Powell Drive between Myrtle Avenue and Jackson Avenue from District R-3 (Low Apartments, Low Density) to District R-2a (Two-Family Dwellings). BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2579, rezoning an area of approximately 7.65 acres generally located north of Bernard Powell Drive between Myrtle Avenue and Jackson Avenue from District R-3 (Low Apartments, Low Density) to District R-2a (Two-Family Dwellings), said section to read as follows:

 

Section 65.010A2579. That an area legally described as:

 

All of Lots 5 to 23 and West 1/2 of vacated alley lying east and adjacent and North 1/2 of vacated alley lying south and adjacent to Lot 23, Block 2, Blue Avenue Park, all of Lots 34 to 52 and East 1/2 of vacated alley lying west and adjacent and North 1/2 of vacated alley lying south and adjacent to Lot 34, Block 2, Blue Avenue Park, a subdivision in Kansas City, Jackson County, Missouri, except for that part now platted as Kensington Place and for that part in streets; and

 

Lots 1 thru 4 and the South 1/2 of vacated alley north and adjacent to Lot 1, Middle West Investment Co. 1st Addition to Kansas City, Missouri, a subdivision in Kansas City, Jackson County, Missouri, except for that part now platted as Kensington Place and for that part in streets; and

 

Lots 27 thru 33, Block 2, and the South 1/2 of vacated alley north and adjacent to said Lots, Blue Avenue Park, a subdivision in Kansas City, Jackson County, Missouri, except for that part now platted as Kensington Place and that part in streets; and

 

All of Lots 5 (except part of Lot 5 replatted Kensington Heights) thru 21, Block 3, Blue Avenue Park, a subdivision in Kansas City, Jackson County, Missouri, except for that part now platted as Kensington Place and that part in streets; and

 

All that part of the Southeast 1/4 of the Southeast 1/4 of Section 3, Township 49, Range 33, described as follows: Beginning at a point 208.5 feet north and 30 feet west of the southeast corner thereof; thence north parallel with the east line of said 1/4 1/4 Section 208.9 feet more or less to the south line of Lot 22, Block 3, in said Blue Avenue Park, thence west along said south line and the westerly prolongation thereof 168.70 feet to the northeast corner of Lot 14, Block 3, in said Blue Avenue Park; thence south along the east line of said Lot 14 and the southerly prolongation thereof 392.4 feet, more or less, to the north right of way line of 17th Street, as now established; thence east along said north right of way line 50.2 feet more or less to the southwest corner of Lot 1 in said W.T. Davis' First Addition; thence north along the west line of said Lot 1 and the northerly prolongation thereof 183.5 feet to the northwest corner of Lot 6 in said W.T. Davis' First Addition; thence east along the north line of said Lot 6, a distance of 118.5 feet to the point of beginning, all in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, except for that part in streets; and

 

Lots 1 thru 6, W.T. Davis' First Addition, a subdivision in Kansas City, Jackson County, Missouri, except for that part now platted as Kensington Place and for that part in streets; and

 

Lots 22 thru 30 (except part of Lot 30 replatted Kensington Heights), Block 3, Blue Avenue Park, a subdivision in Kansas City, Jackson County, Missouri, except for that parts in streets; and

 

The west 15 feet of Lot 99 and all of Lots 100, 101 and 102, Owing's Place, a subdivision in Kansas City, Jackson County, Missouri, except for that part now platted as Kensington Place and that part in streets.

 

is hereby rezoned from District R-3 (Low Apartments, Low Density) to District R-2a (Two-Family Dwellings), all as shown outlined on a map marked Section 65.010A2579, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
