RESOLUTION NO. 200309

 

Directing the City Manager to make recommendations to the City’s existing CID policy to address recently proposed community improvement districts and the City’s general oversight role; directing the City Manager to engage public stakeholders to inform his recommendations; directing the City Manager to recommend a comprehensive and consolidated CID policy; and directing the City Manager to present his recommendations to City Council by September 1, 2020.

 

WHEREAS, the Community Improvement District Act, Section 67.1401, RSMo, et seq., (“CID Act”) allows property owners to voluntarily form a district in which certain taxes and special assessments are levied in return for local benefits; and

 

WHEREAS, the City Council is charged by the CID Act with conducting a public hearing for determining whether a lawfully petitioned district should be established; and

 

WHEREAS, Second Committee Substitute for Resolution No. 120605 was adopted by the City Council on March 7, 2013, for the purpose of establishing the City’s policy for approval of new community improvement districts; and

 

WHEREAS, Resolution No. 130844 was adopted by City Council on November 7, 2013, amending the City’s community improvement district policy; and

 

WHEREAS, recent requests to establish new community improvement districts have created questions as to whether the existing policy adequately reflects the Council’s priorities and provides for adequate guidance to the Council in approving new community improvement districts; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby directed to make recommendations to the existing CID policy that he deems advisable in light of CIDs recently proposed to the City Council. Such policy recommendations should address, among other things:

 

·         Multiple CIDs that overlap over the same property and/or CIDs that overlap with other existing sales tax districts;

·         Tax competitive disparities related to CID sales taxes;

·         Single-beneficiary CIDs and their benefit to communities as a whole;

·         Blight finding standards and blight remediation plans; and

·         Engagement with affected communities, the Neighborhood Planning and Development Committee, and City Council.

 

Section 2. That the City Manager is hereby directed to make recommendation to existing CID policy that would improve oversight and transparency of CID activities and compliance with reporting requirements and obligations under cooperative agreements with the City.

 

Section 3. That the City Manager is hereby directed to engage and gather insight from existing CIDs, neighborhood and community improvement associations, citizens, and other stakeholders to inform his policy recommendations to the City Council.

 

Section 4. That the City Manager is hereby directed to make recommendations as to the creation of one comprehensive CID policy that consolidates prior policy directives and adopted resolutions with his proposed amendments.

 

Section 5. That the City Manager is directed to present his proposed recommendations to City Council no later than September 1, 2020.
