ORDINANCE NO. 001391
Determining
the advisability of the Chouteau Crossing Improvement Project and ordering the creation
of a neighborhood improvement district for the project in Kansas City,
Missouri.
WHEREAS,
pursuant to the authority of Sections 67.453 to 67.475, inclusive, RSMo, titled
the Neighborhood Improvement District Act (the Act), proceedings have been
undertaken for certain improvements for a neighborhood improvement district in
Kansas City, Missouri; and
WHEREAS,
a petition signed by the owners of property within the proposed neighborhood
improvement district has been filed with the City Clerk (the Petition)
requesting improvements designated as the Chouteau Crossing Improvement Project
(the Project), said petition stating (a) the project name for the proposed
improvements, (b) the nature of the improvements, (c) the estimated cost of the
improvements, (d) the duration of the assessments for the improvements, (e) the
boundaries of the improvement district to be assessed, and (f) the method of
assessment; NOW, THEREFORE,
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. The City Council hereby finds and determines that the Petition requesting
the Project is complete and proper in all respects, subject to certification of
the Petition by the City Clerk.
Section
2. The City Council finds and determines that the Project is advisable and
orders a neighborhood improvement district to be established for the Project.
A. The
project name for the Project shall be:

Crossing Improvement Project
B. The general nature of the
improvements to be made is the construction and reconstruction of roads,
bridges, utilities and other public facilities located in the District. A
description of the public improvements expected to be constructed in the
Project are as follows:

C. The estimated cost of the
improvements is $4,356,283.00, all of which will be assessed against the
property within the District. The final cost of the improvements assessed
against the property within the District (and the amount of tax increment
financing obligation bonds of the Tax Increment Financing Commission issued
therefore) shall not exceed the estimated cost by more than 25%.
D. Assessments against the property
within the District will be in substantially equal annual installments over a
period of not more than 20 years.
E. The boundaries of the
Neighborhood Improvement District to be assessed for the costs of the
improvements are described as follows:
All that part of the East Half of Section 6, Township
50 North, Range 32 West, being part of Block 4, Winnwood Beach, all of Blocks 5
and 6, Winnwood Beach, Lot 47, Wood Hills, Lot 54, Wood Hills Annex, and parts
of vacated Cleveland Avenue, Winnwood Boulevard, N.E. 43rd Terrace, and
Loughrey Avenue, all in the City of Kansas City, Clay County, Missouri, being
more particularly described as follows:
Commencing at the Northeast corner of Lot 1, Block 4,
of said Winnwood Beach; thence South 00E38'27"
West, along the West right of way line of North Winn Road, a distance of
520.60 feet, to the Point of Beginning; thence continuing along said West right
of way line South 00E38'27" West, a distance of 989.48 feet, to a
point on the centerline vacated N.E. 43rd Terrace; thence along said centerline
North 89E17'29" West, a distance of 125.03 feet; thence
continuing along said centerline North 76E33'20"
West, a distance of 91.46 feet; thence continuing along said centerline South
89E42'16" West, a distance of 418.76 feet, to a
point of curvature; thence continuing along said centerline and along a curve
to the right having a radius of 130.00 feet and a central angle of 77E45'17" an arc distance of 176.42, to a point of compound
curvature; thence continuing along said centerline and along a curve to the
right having a radius of 490.00 feet and a central angle of 00E19'34" and arc distance of 2.79 feet; thence South 77E46'40" West, a distance of 10.00 feet, to the southeast corner of
Lot 4, Block 6 of said Winnwood Beach; thence along the South line of said
Block 6 North 89E17'56" West, a distance of 63.00 feet, to the
Northeasterly right of way line of Chouteau Trafficway, as now established;
thence along said Northeasterly right of way line North 43E43'32" West, a distance of 243.14 feet to a point on the
centerline of vacated North Cleveland Avenue; thence along said centerline
North 00E35'36" East, a distance of 8.45 feet; thence
continuing along said Northeasterly right of way line North 45E20'19" West, a distance of 238.89 feet; thence continuing along
said Northeasterly right of way line North 24E32'11"
West, a distance of 94.62 feet, to a point on the Southerly right of way line
of Interstate Route No. 35, as now established; thence along said Southerly
right of way line and along a curve to the left having a radius of 3084.79
feet, a central angle of 04E23'04" and an initial
tangent bearing of North 67E32'18" East, an arc
distance of 236.06 feet; thence continuing along said Southerly right of way
line North 49E06'49" East, a distance of 367.40 feet; thence
continuing along said Southerly right of way line North 67E07'32" East, a distance of 107.95 feet; thence continuing along
said southerly right of way line North 49E39'58"
East, a distance of 211.99 feet; thence continuing along said Southerly right
of way line North 18E56'28" East, a distance of 68.21 feet; thence
continuing along said Southerly right of way line north 49E15'15" East a distance of 197.73 feet; thence South 00E38'34" West, a distance of 245.01 feet; thence South 89E21'26" East, a distance of 229.83 feet; thence South 00E38'22" West, a distance of 11.20 feet; thence South 44E21'26" East, a distance of 34.85 feet; thence South 89E21'26" East, a distance of 45.36 feet to the Point of Beginning.
Containing 21.97 acres of land, more or less.
A map of the District is attached as Exhibit B. The
District is located entirely within Kansas City, Missouri, an incorporated
city.
F. The cost of the improvements
will be equally assessed per square foot against all real property within the
District.
Section
3. The improvements included in the Project are hereby authorized.
Section
4. This ordinance shall be in full force and effect ten (10) days from and
after its passage by the City Council or upon certification by the City Clerk
of the sufficiency of the Petition, whichever occurs later.
